    Hi everyone.

    Really happy to be part of this forum. Thank you.

    So today I received a letter from the Northampton County Court with an application made by Lowell who had bought my debt from O2 two years ago. What do I do? Wasn't recorded deliver.. Do I reply to court papers? Ignore it? I see a lot of people have said Lowell's are jokers and chancers.. World they have brought the debt and all the original contract documentation too or just the monetry figure? Any loophole's, etc? Cheers x

    and get the claim acknowledged.

    Then can you post the particulars of claim here and give us a bit of background to the debt

      Hello

      First of all, it would help if you post up a copy of the Particulars of Claim.

      If you ignore a court claim then you risk having a default judgment raised against you and will sit there for the next 6 years likely resulting in you being refused credit at a favourable rate.

      It would help to know some background about the debt e.g. when you took the contract out, when you failed to pay, did you receive a notice of assignment from O2 or Lowell and if so when did that happen?
      If you have a question about the voluntary termination process, please read this guide first, as it should have all the answers you need. Please do not hijack another person's thread as I will not respond to you

        hi guys. it was a tablet and airtime contract taken out in june 2016. contract was in my name but bank details were set up in ex's account name/details. he made the first 3 payments then cancelled the direct debit when we broke up. I made a claim myself to the northmapton county courts but he ignored everything. o2 stopped sending me letters in 2017.how can a company who buys your debt take you to court?

          Because they have bought the debt and all the rights to it.

            wow... so would they have all the paper work too? I watch a lot of judge rinder (don't judge me lol) so I'm hoping the fact he agreed and made the 1st 3 payments will mean he accepted this and the court will chase him not me ???

              If the debt is in your name, then you are the only person they will chase regardless of whom paid what. They may not have all the paperwork, that's the point of requesting it.

              Acknowledge Claim - within 14 days from Service

              Defend Claim - within 28 days from Service (IF you acknowledged in time)

              If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
