  • Debt Managers/Restons Court Claim Form (catalog)

    Hi, I'm hoping someone can help with my next steps please. I have received a letter stating as below:

    Particulars of Claim:
    The claimant claims payment of the overdue balance due from the Defendant(s) under a contract between the Defendant(s) and Next Directory dated on or about XX 2011 and assigned to the Claimant on July 2016.

    PARTICULARS a/c no - ABC123

    Date Default balance Value £2000

    Post Refrl Cr NIL

    I have already acknowledged the claim on MCOL, I'm unsure which letter template I need to use with it being a catalog and it defaulting according to Noddle in 2014?

    I appreciate any help in advance.

      Thank you, I'm not sure what to put on my CPR request letter where it says only to mention what is under the Particulars of claim on the claim form I received. There isn't really anything, just an amount as above?

      Also, does the SAR go to the claimant or the solicitor, it doesn't say?

          Mention whatever you want in the CPR letter. They only have to supply you what is mentioned on the claim form but they will have to give you additional stuff later if it goes all the way to court if you mention any additional docs in your defence & witness statement.

          The subject access request goes to the catalogue company.

          Acknowledge Claim - within 14 days from Service

          Defend Claim - within 28 days from Service (IF you acknowledged in time)

          If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
