    Yes, just wait for the next directions from the court now.

    It will have been received and stamped by the court as being on time, but they can be a little slow in actually updating things and so not to worry.

      Hi guys, just an update (not much of one really) all is quiet on the homefront.

      Since I filed the DQ I've received nothing in the post and MCOL hasn't been updated either since the DQ was received.

      I'll post as soon as I hear anything, any ideas why it's gone quiet?

        Possibly the other side haven't filed their DQ - maybe give the court a call to check what's happening? You haven't received a copy of Lowells DQ either have you ? If they haven't then they are likely to have been given 7-14 days extra time to file it or be struck out.... that time has passed now so worth a call. Otherwise they might have filed and the case is just in transition from CCBC to your local court.

          Thanks for your response sorry for the delay.

          I will certainly give the court a call tomorrow and see if I can find out a little more information.

              Hi everyone, so finally managed to get through to the court.

              Still 2 months down the line since DQ was filed and the court tell me it's still at mediation stage and he said he will refer it again as it must have slipped through the net due to it being busy at this time or something.

              So I'm feeling rusty on this subject now as it's been quiet for so long. I'm guessing if mediation contact me then Im not happy to mediate due to Lowell not supplying what I've asked for.

                Hi all,

                Not sure if anyone is still watching my thread or not, but just another update.. still heard nothing since I made the phone call to them 2 months ago, so it's been 4-5 months since I filed the DQ.

                Any ideas on what's happened? Does it sometimes take this long for things to get processed? Checked the MCOL again just and there is no new information on there.

                What are my options at this point? Can i request it to be thrown out as they haven't done anything with it?

                    Please keep updating, I am currently in a similar situation with Lowell and this thread has been very useful. You are further along the road than I am as I have just responded to Lowell Solicitors stating I am contesting the full amount; same story as you though, they have provided no evidence that the debt is mine other than a "statement" which isn't even on company headed paper!

                        It's a little strange you haven't heard anything at all as both parties have filed their Directions Questionnaires and it should have been sent over to your local court and directions / a court date issued by now - it's over 6 months. Unless it's simply stuck in Mediation somewhere - but you should have had SOMETHING by now. Also the other side should have sent you a copy of their DQ so tell court if you haven't had it still ( we know they filed it from MCOL ).

                        Definitely ring the court and find out what's happening.

                          Hi amethyst,

                          Little update, I received a letter on friday saying the case has been allocated to my local court. No dates or anything like that on the letter and I haven't received a DQ from Lowell either.
                          I'm a little nervous now as it's been so long since I did anything with this I feel like I've forgotten what's going on, Lowell still never produced any solid proof of the debt only stating my name and previous address etc.

                          I need to do some recapping on this thread from the advice I received, basically I know that phone contracts aren't governed by the CCA but I'm sure someone mentioned that there still should be copies of documents that would have been signed by me that would need to be provided, or something along those lines

                            Bump, received court date says I need to submit witness statement within a month, not sure what I. Need to do on that if anyone could give me a few pointers I'd be very grateful.

                            It looks like the court has ordered Lowell to produce all the stuff I asked for in my defence in the meantime, feeling positive about it at the moment I would have thought Lowell would have provided me with what I asked for long ago if they actually had it.... But who knows
