There isn't a cost attached to filing the N225 btw xxx

will have a read through your WS a bit later ( teatime) but it shouldn't really be necessary as it's a procedural thing rather than a decision making thing - your counterclaim was filed with your defence ?

Is this ok for the Witness Statements, I've taken the appropriate information out so that you can't see anything

I've updated post #192 as to where I would put each figure.

Do a short witness statement to go with the application explaining you filed the Defence and Counterclaim on 10th April (or when you did), obtained a doctors note at a cost of £25 as evidence relating to it, the Part 20 Defendant has failed to file a Reply or Defence to Counterclaim within the prescribed deadline and I respectfully request the court enter summary judgement on the Counterclaim for £1,323.65 comprising £967.29 owed, interest of £6.36, issue fee of £70, cost of obtaining supporting evidence of the claim £25 and the cost of making this application £255.00.

So I have numbered the boxes for ease of reference:

    1 & 2 - as you have them
3 - the amount of the cheque you sent the court when filing the defence and counterclaim form
    4 - 0.00
    5 - the subtotal of 1,2 & 3
    6 - 0.00
    7 - sames as 5
    8 - 0.00
    9 - same as 7
So I don’t add the fee for the doctors note

Have you had notification that the case has gone to a local court yet? I assume it was CCMCC you spoke to yesterday?
Court fee’s shown on claim - I’ve put the costs of entering the documents here including the doctors note, so £70 + £255 + £25

Legal Representative costs - there shouldn’t be figures here, I’m just roughly writing it out

do all the costs including the fees go into the “amount of claim as admitted”?

no, I’ve not been notified of a court as yet

    It's Salford

    Don't forget claim number.

Looks like you have filled it in right to me, TBH I'm not 100% sure about the PArt 20 part but the court can work it out I'm sure .... strange form as you tick not admitted or defended, then the amount says ' amount admitted' ... tsk ! Trouble with trying to use one form to do many things I guess.

Well it won't be as the Defendant is given preference to their home court if they state it to be, hence what we wrote on your DQ.

no, it hasn’t and I think that’s because she’s doing this out of spite instead of thinking things through or finding out how it should be done. When I was being harassed by her, she stated that she would take me to small claims court and it would be done “ up north”” because that’s as she stated was where she had done it before.

Money is not an issue for her, so I wouldn't be surprised if she got advise, but her solicitor does not always seem 'on the ball' with this.
