    It's just the wheels of the court turning, don't worry too much as you have filed everything needed and your letter is good to go.

    It's all about the hearing now.

    Yep, all typed up and sent minus the last paragraph.

    I’ve now received a letter from the court saying they have all my paperwork, it’s been filed and that the court date was sent out to me in June, and that they don’t know why the lady at the call centre said I was never sent it!!

    Feel like I’m hitting my head against a brick wall with these guys and the wall keeps getting bigger

    i have however, received a letter from the court stating they have received my Witness Statement and Evidence, but it also says that a letter was sent to me regarding details of the hearing date back in June, which now contradicts the information from the call centre who said that nothing was sent to me only the claimant!!

    That wall all keeps getting bigger

    Do you actually want a McKenzie friend or a Lay representative ?

    McKenzie friends can't talk on your behalf, whereas a Lay representative can.

    Ahh reading back you want your husband to speak for you ? I'll grab a request letter for you.

    Okay here's an example you can amend ( obvs the second para wants ditching but there is no need for any 'form') Then speak to the Ushers when you arrive at the hearing to check the Judge is aware.

    I am writing to inform the court that my Husband, Mr xxxxxxxxxxx, will be speaking on my behalf at the forthcoming hearing on xxxxxxxxxxxxxxxxxx 2018 at 4pm. I suffer from anxiety and I would appreciate it if he could attend the hearing with me and act as my Lay Representative pursuant to Section 3 of The Lay Representatives (Rights of Audience) Order 1999.

    In addition, I would like to bring it to the court's attention that the claimant has failed to comply with the order dated xxxxxxxxxx that stated Witness Statements should be exchanged by 4pm on xxxxxxxxxx / 14 days before the hearing. I filed and served my Witness Statement on xxxxxxxxx. I have, as at the date of this letter, received no Witness Statement or supporting documentation from the Claimant.

    I have found a McKenzie Friend template online, can someone please check it to make sure its ok and should I do a covering letter asking that the McKenzie Friend be able to speak on my behalf? I have started on the covering letter, so it just has the bare bones in it at the moment.

    I have been told to email the court and put ‘urgent’ in the subject heading and explain the situation, which I’ve done and to bring extra copies of the Witness Statement and evidence on the day.

    That needs to be in no later than 7 days before the hearing, so if Amethyst can oblige with a template you can do it as soon as you are ready.

    After that it's just about court etiquette and then making sure your husband is comfortable explaining your defence and if necessary the counter claim.

    Ok, everything has been sent to the respective people. I’ve put my copy of everything into a folder with dividers. So what do I do next? When do I send the letter to the courts requesting my husband as lay-person?

    You must also send the witness statement & all other documents you want to produce to the court to the claimant.
