    Sorry again for sounding stupid but the CPR 31.14 I am filling in (given from the link above) says creditor name address and account number. Is that the claimants name-Lowell or the address given for sending documents - Overdales. Also the account number, as there are 3 particulars of the claim do I use those reference numbers or is it the claim number I put in here? Sorry for being a pain

        Hi all so I sent off the SAR (& £1 P.O) and the CPR 31.14. And today I have received 3 emails from Lowell (the claimant) saying Thankyou for you 33p payment for each of the original creditors and asking me if I want to set a payment plan up?? I’m really confused as I thought the £1 P.O I included was for them to send me information. What should I do now??

          You don't need to send off any monies with the SAR request.

          On their (Lowell's) website follow their complaints procedure. State that the £1 was sent in error and it wasn't a payment, they are fully aware of that. Explain that if the matter isn't resolved satisfactorily, then a complaint will lodged with the Financial Conduct Authority and the Financial Ombudsman Service.

          They are just trying to be 'clever & cheeky' at the same time.

            Ok Thankyou. I got hopeful that if I set up a payment plan for the 3 debts with Lowell it wouldn’t go to court, but that must not be the case.

                The £1 was for the CCA Request, what they sometimes do is return the £1 fee. If you have 3 account's that would be £3.

                That £1 fee isn't a payment, that is what they say, they have used it for.

                You need to find out what is what i.e. have they sent a compliant CCA etc, before you decide what to do next.

                  They appear to have split the £1 between the 3 accounts. Do I contact Lowell to find out if they have sent the CCA? I’m really confused as to why they have done that and then asking me to set a payment plan up..which I would be happy to do if it didn’t go to court. I’m a bit brain fried with it all

                    Court (Hearing) is a very long, long way off.

                    You need to do as advised in post 19, posting the same thing over again is 'unhelpful'.

                          Lowell’s response is they have sent the request to overdales to acknowledge request as the debt is assigned to them. They were about as helpful as a chocolate tea pot

                              Do I need to contact overdales now? I’m so confused. I thought Lowell would have to send me the compliant CCA so why did they send it to overdales?
