      hi

      we run a car garage ,we are currently going through a small claims case , which is against us ,however

      the claimant has not replied to our defend in over 4 weeks ... is there a time limit on a case like this or not

      any advise would be very grateful

        Please upload a copy of the particulars of claim and your defence with any identifying information removed if you'd like advice on it.

        They have 28 days to reply to the defence and file notice they wish to continue the claim, they do this to the court whom will in turn inform you in due course.

            NOTE: If you receive a court claim note these dates in your calendar ...
            Acknowledge Claim - within 14 days from Service

            Defend Claim - within 28 days from Service (IF you acknowledged in time)

            If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
