      I have sent the information as requested confirming my DOB and await further correspondence from Next, also posted the letter to Rostons asking for the details as outlined in the pre-claim.
      I have received a letter from DMS today enclosing an agreement of my account, it shows me absolutely nothing, unless I'm really not reading it correctly !!

        Have you edited out total charge for credit etc on there or was it just blank ?
        It's not signed and looks like one of those agreements they used to send with your first order that not many people actually ever signed and returned.
        What date is the agreement meant to be ?

          The agreement came as you see it, totally blank, I have no idea in all honesty what the agreement date would have been.
          Should I just see what Next and Restons now come back with, they received their post by recorded delivery yesterday ?

                I’m confused. On the 20th of June Debt management services letter says please find enclosed a copy of the agreement and yet your latest letter from Reston dated 6th of July says we are unaware of any request being made to their client? Am I reading this wrong.

                  They may have sent that agreement under the CPR 31.14 request rather than the cca request. They don't appear to have informed Restons that they have sent that. I'd respond to Restons with a copy of the letter and postage receipt if you have one, or just send them a CCA request with another £1 FAO their client, Debt Managers.

                  Editing a PDF doesn't really work unless you have the full Adobe version and can use the redact tool... it's easy for anyone to just remove the scribbles over the personal info otherwise. I've screenshotted it as a png image so should be okay now

                          I don't think you're reading this wrong, DMS it seems are trying to get me to deal with Restons despite them advising Restons to proceed. I filed a CCA request and sent £1 Postal Order that was sent back (I didn't copy Restons in at the time) hence the responses, everything I have posted is in sequence of sending/receiving/replying etc...

                            I have the original letter sent to DMS who sent the Postal Order back to me and referred to Restons, I will copy Restons in to the letter and response, should I add anything else in order to get the timescale extended ?

                                This will want adapting to suit your letter about 'heres a copy of the request sent to your client and their response' …..

                                You will be aware that I have requested further information from you regarding your clients claim No XXXXX relating to a debt allegedly previously owed to xxxxxxxxxxxxxxxxx.
                                As I am yet to receive any information from either yourselves or your clients to enable me to make an informed decision in defending the claim I would like to request your agreement to an extension of 28 days to the date for filing my defence as allowed under CPR 15.5.
                                If you could confirm to me in writing that this is acceptable to your client I will inform the court of the extension in writing.
                                Considering the current deadline for submission is the xxxx xxxxxx 2014 I would appreciate a response by return.

                                maybe also put in something about how their client sent a random copy of a leaflet that you have never seen before and doesn't actually appear to relate to your account....but certainly doesn't comply with the requirements under the CCA 1974 s.78 ( running credit )
