  • Help being took to court by lowells -Bw legal

    I posted earlier as guest then seen the court thread
    Evening I hope someone can give me some advise asap
    I have been fighting Lowell since august 2014, they said I owed a debt to a company and I disagreed I wanted proof ie the signed agreement it went to court in nov 2016 and it got "stayed" still no agreement then December last year got all the letters starting again so asked for the same thing as I genuinely didn't think it was my debt anyway it is going to court next week and I have had all the papers come through with a copy of the agreement which I have signed I have been trying to get through to the litigation team today to try and settle this with no avail I have emailed Friday and yesterday with no response could somebody advise the outstanding amount is £952.89 which I cant pay in one lump sum

      I'll give Amethyst a shout for you.

      In the meantime it would be helpful to know what the alledged debt is for ie credit card, loan etc. Also could you post up the particulars of claim and agreement (redacting any personal info) or send it to Amethyst at admin@legalbeagles.info with your username in the title?

        With the documents they have sent you have they sent a cover letter saying they will be applying for a summary judgement at all ? Or have they just had the stay lifted and your hearing is set for next week ? Have witness statements been exchanged ?

        You can attempt negotiation to settle by instalments if you feel they have provided all the documents and you don't have a further defence to the claim.

          Morning sorry for the late response been working yes they have sent witness statements the original debt was for provident they said I owed £669.50 but it has gone up to the above amount provident wrote the debt off in Sept 2014 but in these papers Lowell have sent a letter saying they bought the debt in August 2014 I have tried to settle the debt over the last few days as its my signature on the original paperwork they came back to me for all my details which I have supplied they have given me 20% off and banged another £210 on for a consent order making it over a thousand pounds paying it at £20 per month were in court on the 18.05-18 and they have given me to the 16.05.18 to sign it should I accept it or go to court and argue the extra charges I have no idea what to do worried sick any advise would be appreciated

                  What they have sent you might have your signature on it, but that doesn't mean that it's what they need to win the case.

                  Read the terms of the agreement they have sent, does it refer to insurance products or other terms? If it does have they sent you those terms?

                  Did they send you the notice of assignment which is a letter from provident confirming they have sold the debt to the claimant?

                  My advice would be to go to see s Solicitor with all they have sent, let them advise you on if they think there is anything missing. It's always a good idea to have solicitor look at any Tomlin Order anyway, so they can look over that too.

                    Have they sent your full payment breakdown, and does it look correct ?

                    Are the terms from the back of the agreement there? Default notice, notice of assignment ?

                    Did your collector stop stop coming round and take away your payment book before the end of the loan ?

                    Consent order normally £100 to lodge with the court. So they must be adding legal fees on top. Although with a £20 a month offer it's quite good to actually get a consent order agreed tbh.

                    Could you post the schedule and terms of the consent order

I'd set up your standing order 10 days before the end of the month if possible so there's no issue where there's a bank holiday or anything. I've left the schedule off due to the confidentiality clause but it looks completely standard The letter explains the additional cost of the consent order as they are aiming to have it sealed at the hearing.
