        Not sure if this will help if the Berdale Centre is being wound up.

        Those of you who have been paid with a bouncing cheque can issue a Notice of Dishonour under s.48 of The Bills of Exchange Act 1882.

        After this a Court claim can be issued at your local County Court. In these circumstances their only Defence is:

        1. Duress: The person signing the cheque would be made to do so because of unlawful pressure brought to bear against him. The law relating to duress, which has developed largely through the courts on a case by case basis, makes the burden of proof very difficult for the person alleging duress and it is quite rare for this to succeed unless good cause can be shown.
        2. Fraud: The person who signed the cheque was not the signatory or the person purported to be. Again, the person who wishes to rely on the defence faces a difficult task in proving their claim as the evidential burden is again high.
        3. Failure of consideration: This is that no bargain is given in return for the cheque. Providing there is some (however small) consideration then this defence will fail as the courts are not there to determine whether or not you’ve got a good deal but just to determine whether or not there was sufficient consideration.
        4. In respect of an illegal contract, which is a contract which is illegal to enter into and therefore unenforceable, therefore once you have received the cheque the chances of not receiving payment are relatively small as this is an unequivocal promise to pay.

            Please note that as from 9th Jan the Registered Office of Berdale Centres Ltd was changed to
            Wake Smith
            68 CLARKEHOUSE ROAD
            SHEFFIELD.

            I called them but they would not give me any information at all, quoting "conflict of interest"

              I am currently an employee of LTS. I am currently trying to resolve these payment issues and would welcome any information regarding businesses involving the above named party. (especially former employees and sub-contractors of LTS).
              I am wanting to help as much as possible, but I will not make any promises. So please PM me.

                Michael101, if you are an employee of Mrs Berhanu surely she has informed you of who the employees and subcontractors are who are owed money?

                    I am new to this site. I have an interview with Michelle for a job that I would like. I am now concerned by these posts. Am I likely to be unpaid? Has anyone worked for Michelle before and if so did you not receive the monetary package promised? Thanks

                        Michael101 - are you dealing with Berdale Centres Debts too?
                        Or are they just being swept under the carpet?

                        jmd - If I found that I was having an interview with Mrs Berhanu I would just not turn up (but that is just my opinion)

                        In my personal experience I have found her to be, let's say, very untruthful to staff, creditors and even her own family, and is very dishonest when it comes to dealing with money (and yes, I would be prepared to state that in a court of law, along with evidence accrued over the last 4 years, if only we could get her there!)

                          I am yet another person owed money for teaching from LTS. Has anyone tried to take them to court? I am just interested in what the obstacles are and would be grateful for any information.

                              For information about LTS registered address. Although Wake Smith Solicitors say they are still the registered address, they just told us that they are no longer acting for them and therefore not forwarding mail on to them!!
