Don't know yet, first one we've helped with has only just gone off.... and claimant has 28 days to respond to the defence so we won't know for a bit xx

Re: *** Scammed v BPS - claim form dated 23/2/2015

Done it online with the Entention to defend myself but I was wondering of he sends all of those people to court as we are all in different area of the country would we have to travel to the court close to him or will it be one close to where I live? And If the later does it mean he is going to spend all his time travelling from court place to court places??? Or Am I missing something very obvious... Sorry for all the questions. Great job on that bbc radio as well. Made me feel less scared

It's your local court... He has to travel to you... If he actually bothers

Is this invoice complete? Is this as you received it? Is there any other part of it? This is important. This is a VAT invoice and must show the VAT number of the company charging VAT

The vat number is on the bottom of the invoice. The bit posted on here is the charge list, breakdown of charges, rather than the invoice. The VAT number as been checked out and umm checks out.

Yes hearing will be at peoples local courts. He ha told someone he has solicitors across the country... which he doesn't.... so I dont expect him to attempt getting through a hearing with this.

So do you think it actually will go to court? And if he doesn't bother turning up surely that's good for us right? Did you hear more from that email you received about the bailiff? That worries me as we are looking at getting a potential mortgage

Re: *** Scammed v BPS - claim form dated 23/2/2015

If you did lose at court (unlikely) then you would have 28 days to pay before it would be entered on the register (ie before it would appear on your credit file) If you paid it within those 28 days then nothing is entered on the register or your credit file.

The talk about bailiffs earlier was BPS trying to intimidate a lady into making payment.

The facts are he could not instruct bailiffs for at least 28 days after judgment, and then has to give 14 days pre notification.

He also cannot bankrupt you, the minimum for bankruptcy is £750 (at the moment) going up to £5k in October.

We do have to play it by ear a bit so we really don't know at this stage if he will go to a hearing. We have two hearing dates booked in May so far, so a way to go to find out how far he is willing to test this.

Do we know when my next step is due? Haven't had any acknowledgement of my online log in with intent to defend in full yet. Should I worry? Thanks again for all your help

I don't think you need to worry, but if you are worrying ( and I know you do worry a bit ) give the court a call (( 0300 123 1057 / 01604 619402 )) and check that they have had your acknowledgement okay.

Your defence is due before Friday, March 28, 2014. We can put it in before then if you like, just I'd rather hang out till about 20th so you don't get allocated to a hearing before a few others have been through the process.
