    Just been nosing at the 30 or so others I have, and same pattern up until contact was made....which I suppose is to be expected .... collections process

    and actually, looking at a couple with incoming emails from the customer, they are just ignored and the process continues.

      Anyone who's actually run a business can tell you thats not how these collections run, its not clockwork. Nor would it make any sense if you email a debtor to fire a letter off at the same time. You would try different methods at different times.
      Look at our pet DCA'S they don't simply send out in a clockwork sequence then automatically send a court claim after x letters.....
      A more realistic explanation is this is a Excel spreadsheet being quickly altered and disgorged in order to pad up these claims. :tongue2:

              Have you heard anything from court yet? You should get a letter to say you defence has been fwd'd to claimant and they have 28 days to respond ?

                Received Acknowledgment of Defence & Counterclaim today. N180 to be in by 23/03. Matter moved to our local, however, as the Defendant is a student in Newcastle, I am wondering whether we should have it transferred up there. It might mean a certain someone having to travel 275 miles!

                      Phew !

                      Are you okay completing the N180 ?

                      I'd go with the court that is going to be easiest for you both to attend... which is probably going to be the one closest to you rather than Newcastle. You'll have at least a months notice of any hearing so should be okay to organise things. (I do doubt it will come to that though but we must be boy scouts about these things)

                        N180 looks straightforward. Definite NO to mediation! Will go with local court (Barnsley - they don't take any nonsense in this town believe me!)

                              Hearing is on 1st June.

                              Bundles 14 days before

                              hearing fee by 29th april ? not sure if thats payable by both parties being this has the counterclaim in place.

                                Acknowledge Claim - within 14 days from Service

                                Defend Claim - within 28 days from Service (IF you acknowledged in time)

                                If you fail to Acknowledge the claim you may have a default judgment awarded against you, likewise, if you fail to enter your defence within 28 days from Service.
