  • PPI Claim Company invoice for Work not done

    Hi guys,
I've been a silent watcher of this forum for the past 3 months or so.

    Here goes the story...
My mum applied for a PPI through a company which put in a complaint for her. Well to say they were very helpful was an understatement. After sending the forms off to the PPi company, a waiting game began. Apart from contacting the bank about a PPI claim request, they didn't do a lot since then. My mum had to call their premium numbers after little to no contact or updates over a 2 month period. Stories like the case worker on holiday to they'll 'get back to you' (they never did)
The bank finally replied to say the PPI had been claimed (which was false) and the PPI company sent a letter to that effect. They also passed her on to the bank to call herself since they said 'its been claimed'. Which she was able to prove she did have PPI on.

After that period, the PPI company offered no service since they'd thought there was no claim. Again, the PPI company was contacted often times on premium rate numbers, but did not take it up with the bank on the rejection. (they were only as helpful as getting a contact number to talk to the bank directly) There wasn't any form of correspondence again since the 'ppi already claimed' letter. At this point a letter of cancellation was written to the PPI company as they effectively put her in the clutches of the bank themselves to deal directly with.

I finally took it over after that period and after convincing them there was indeed a PPI claim possible. An investigation followed and the result of their investigation was 'unsuccessful' citing flimsy reasons. I composed the reply letter which I painstakingly had to write myself over a long period of time reading replies on here to fight the case. Couple of weeks later plus hour long calls from the bank they finally replied and she got a successful claim.
Now the PPi company has gotten wind of this and is now requesting a payout. Besides, they also put in an erroneous invoice of over £3000 as fees (the claim was less than £3000)

I'm pretty sure they are just now piggybacking over a contract signed but the FACT is apart from submitting a claim on her behalf, they did nothing else once they heard the PPI was already claimed. (which turned out to be untrue)

After a rejection from the bank, they did not update or inform of other measures taken to fight the bank at their word. She was left at her own mercy to fight the claim herself.
Now where does she stand on this?
Have they any grounds to seek a fee seeing they did not do their job?

        Thanks.

They don't seem to have a website I can find so I can't readily check their terms and conditions. Do you have them?

Claim4you Ltd trading as pleasefreeppicheckme appear to be authorized by MOJ though.

Can you post or type up the text of the ''it's been claimed'' letter they sent you, excluding any personal information?

There lies another issue because we had to call the PPi company to enquire about the claim. they said they'd sent a letter from Halifax which claimed the PPi was claimed. (We never received from them) Just a verbal confirmation over the phone that there was no PPi available. They later passed her on to Halifax to talk to directly who also told her initially that the PPI had been claimed.

Ok. Do you have a copy of the forms that your mum sent to them?

I've found their site http://www.freeppicheck.com/ and I can see that they're not compliant with regulations which oblige them to make available their terms & conditions on their website.

The only forms from them were the initial 'Enquiry Form of Authority' sent as far back as April 2014. They was no 'Terms & Conditions' attached to it. Just a simple letter stating she 'fill in the enquiry form' asking details of the bank/lender
They also asked that she shouldn't fill any forms from the bank as they'd handle it themselves. Well, the bank claimed never to receive any reply from the questionnaire at any time nor did Claim4you indicate they responded to a questionnaire reply from the bank.

Also after informing them of not receiving a letter of 'already claimed' they said they would send another which never arrived to this day. They then insinuated they couldn't go any further with the claim hence passed us her on directly to the bank to talk to herself even after telling the PPi company the info was wrong.

How much have they invoiced your mum for?

I'd like to see the invoice.

I would write a formal letter of complaint to them and include a request for the contract that your mum signed with them. If you're not satisfied with their response you'll be able to take your complaint up with the Legal Ombudsman who will be taking over CMC complaints on January 28.

                    Thanks.

The figure they must be charging is £2500 (+ VAT of £500).

I'd make a complaint (and ask for the contract) as you'll have to exhaust their complaints procedure to be able take it to the Legal Ombudsman.

Well. Even the payout was less than the amount on the letter.
                      So what gives?

I'll write a letter and was also contemplating calling the Ministry of Justice.

To be honest the MOJ won't be any help to you I'm afraid.

Let us know of any developments.

I'm having the exact same issue with claims4you and even the MD Frank Johnson has a disgusting attitude! There has been so much confusion with who I actually signed a contract with and there was no communication from them at all, after Barclaycard sent me a letter declining the initial claim, until I got a threatening voicemail yesterday demanding £400 by the end of the day!

Can you tell us a bit more about what happened and the sequence of events.

Also do you have a copy of the contract you signed?
