        Did you include in your complaint that the copy of the second form you allegedly filled in had a different account number to your capital one card account that you had applied for and been granted six weeks earlier?

        Might be an idea to post up your copy of your complaint to align it with the ombudsman's and cap one's decisions.

            You could take a photo with smart phone/camera and upload that if your scanners being pesky.

              Sorry scanner's packed up again so hope this is ok. This is the only photocopy Capital One provided of said later agreement with totally different account number ?

                    Did you have more than one Cap One account?
                    That's all they sent even after various requests for further information - And no not to my knowledge and did query it but never received an explaination ?

                    Do I still have a case to reject their decision ?

                      See what Ame thinks about this as well, but I note you did comment at the side of "you not saying that", but I would be interested to know on where they got the info/proof that they assumed you did.
                      I note they say final, but wondering on the scale of lack of proof to them if you could just question them and tell them you have no idea where that come from, and state your not able to decide on the signing as yet because of that and would like an explantion please.

                      However, if you believe they did not deal with your complaint like they should have or unfairly as such, you can request for an assessment review by the contact info I posted on an earlier link above.

                      Do see what Ame says as first though, she may have better suggestions for you here, as something may also be amiss too.:tinysmile_twink_t2:

                        Di many thanks again and always appreciative of your time.

                        I have until 10th June to either accept or reject their decision but I would rather try and put something together that will argue the case strongly as I am disappointed in the decision and the reasoning given. So yes any further assistance from Anne would be very much appreciated.

                        Regarding the account number query mentioned, I have again contacted Capital One for their explanation as the account is still open.

                        If any further info needed, I will try and answer the best I can as I do not want to give up without a fight with this one !

                          You have two of this sites best experts working on your case and they will not let you down.

                          I think the Ombudsman's wording is interesting...... Use of "I think " rather than I am sure? Following on from what Di said, before you sign anything ask for clarification of the discrepancies between the application form and the other slip of paper.

                          Maybe just check out a couple of things yourself. Capital One, when they did mail shots, put an "application number" on the initial application form. This is different from the number that ended up on your credit card. So have a look at your statements, application number and credit card number, just to make sure there is absolutely no overlap. Then I believe that you can ask the Ombudsman to explain all the discrepancies. I don't think that Capital One will respond to any query you have while the case is with FOS. (They would not discuss anything with me on mine).

                          I know that if you don't win, it will not be from lack of help and assistance from Di and Amethyst. I will add anything extra that I can think of. With a heart and a half I wish you all the best; and it will be no trouble to answer any questions I can.

                            Thanks again L'pool64 and all help is appreciated as I need it with this one.

                            Shall I contact the Ombudsman in writing asking for clarification as mentioned and perhaps ask for an extension ? Or is it too late for that as I had missed my opportunity with the adjudicator ?

                            I was also going to submit a SAR tomorrow for the sake of it (and yes should have done one with this lot) just for a peace of mind to see if they submit any other details of the signed sheet or perhaps for evidence going forward. What annoys me is that I had previously requested clarity from Cap One on numerous occasions in respect of different account numbers and better details of signed agreement, but they never provided an explaination or details.

                            I also mentioned this to the adjudicator and even they don't seem to have picked up on it but have just closed the case and thank-you very much and good-night !

                              I would contact the Ombudsman both in writing and by phone. When you phone them, tell them that you have sent a query by e mail, so that they have it on record/ file. As the matter is now urgent, could they look at the mail and discuss it with you? (They can only say "no". As well as raising everything else, You could say something like, "you may have the answer to my queries that I have raised previously and perhaps the answers have been overlooked etc......what answer did you get from Capital One, because I didn't get a copy of it ? Or I believe this is most significant as it is crucial to the final decision???"If they try to tell you it is not significant, just ask them to explain to you why?

                              You could then ask them to come back to you re the date? Amend the wording above, to suit you Bazza.

                              Hope this makes sense. At this stage stand your ground with FOS, be like the "broken record". They will then tell you what will happen next.
