Re: Capital One PPI claim rejected by Ombudsman
I made a PPI claim from Capital One in 2013 which was rejected. I made a complaint to the FOS who telephoned me and I informed me that they could not look at my as I had not received my full and final letter from Capital One.
I wrote several letters to Capital One asking for a final letter and requesting that my monthly PPI payments were cancelled.
Capital One eventually responded and I forwarded this letter to the FOS. Capital one also provided me with a premium rate number to call to cancel my ppi payments the number was always busy and took me days to get through. A representative from the FOS office telephoned me and informed me that my original claim for was on a "old style" form and I would have to submit my complaint using the "new style" form. I submitted a further complaint form as requested and heard nothing for months. I chased the FOS and they have denied receiving any paperwork from me and have denied making any telephones calls to my mobile phone and landline. They have rejected my claim due to the 6 month limitation period. I have paid Capital One almost 10 years of ppi payments and I understand that this may be the reason that they have refused to refund the money as they could not produce ant evidence that I had accepted ppi payments option with my original application form.
I am at a loss as to what to do next there is little information on the internet however I do believe that I can take Capital One to court but there is a risk I could lose and end up having to pay their legal fees.
Can anyone advise if they have been through similar.
