        Update.
        Had asked FOS to look at this again.
        Just had a phone call, guess what despite the claim they look at both sides, in the absence of records the adjudicator considers that the offer was "fair and resonable and within guidelines."
        They apparently have a copy of a letter of cancellation I did not get this in my SDAR bundle.
        Asked that it now goes to adjudication and will now complain to ICO and OFT.
        Nothing to lose now.

          Now got copy of this supposed letter.
          From 2001. at old address.
          Balance at the time was in excess of £2,000 and if I have this right PPI premiums had been charged from inception in 1997 according to my poor copy of the application form I had ticked the NO box) without sight of the statements from this time would the refund of just over £100 be right?
          As they are now in breach of a valid CCA and SDAR can I still dispute and not pay them, balance down to just over £350 now.

                  E mail from FOS, they are going to refer it on but warn it could take up to a year.

                    Wonder if you had the same Adjudicator as me (female) I know there's lots of them but it seems like what evidence we provide to the limited info the bank send (not)!! they use our's to use against us!!

                    So its being passed on to the Ombudsman then?

                      Its so annoying Di, its now the principal of the thing.
                      Checked SDAR again and the letter they were supposed to have sent was to old address back in 2001 was not sent within that bundle and they claim that was all they could find.
                      The SDAR in the main was illegible and as I posted earlier had a ream of "dot-matrix" type paper.
                      It is clear even from the very poor copy of the application form that the "no" box was ticked so I should have had some sort of evidence that I subsequently agreed to the PPI being added,
                      About to e-mail the person again (yes female with sorry if this sounds prejudiced, an Asian name.)
                      This is not the first complaint that they have "sided" with the a bank or lender even in my own experience.
                      As the card is now defunct and I think it was Angry CAt that said that the application form does not contain prescribed terms and conditions it could be considered unenforceable.

                        Well well well.
                        You remember that I e-mailed the executive's office while I was awaiting the FOS?
                        Reply today they ADMIT they made a mistake and have recalculated the offer.
                        Enough to pay off outstanding amount with a little bit left for me!!
                        Persistence paid off and without the FOS!!!
