hi we went with lifestyle claims for our ppi we did not hear anything till tues 18th dec 2012 when we had a letter from redhawk legal saying that lifestyle claims went bust and they took over the company. they sent us a form to fill in to claim back our money we did not send anything back to the company as we never heard of them. we got paid out from our bank on the 14th dec 2012. then we had another letter off redhawk to say we owe £600 for their services. why should we pay someone who we never used do we pay them or not as we went through lifestyle claims.

Have Redhawk Legal ask you to sign a Letter of Authority (that expressly transfers the contract you had with Lifestyle to them) or is there any mention of this in their letter?

Hi, if you by any chance still have that letter could you please pm it to me, Tuttsi or Exc personal details removed if possible.
It would help us with MOJ complaint if we know exactly what they are putting on these forms.
            Thanks Enaid x

I fully agree with Enaid but I am not sure if you can do attachments on a PM. So if you could upload it here on this thread without your personal details we will be able to forward this letter to our contact at the MOJ which will substatiate what is going on.

We had a letter from Redhawke on the 13 dec 2012 saying we need to sign two forms and send back within 48hrs to give them authority to act on our behalf which we did not do. Then we had another letter from ULL Solicitors asking us to sign the paperwork so they can carry on with our claim from lifestyle claims. if i could have your EMAIL ADDRESS i can send u the paperwork for both of the companies as i dont know how to add it to the forum as i am new to this. Just had a phone call to day 7/1/13 from redhawke asking for their money. they said the adminastrator has appointted them to take over lifestyle claims. They said they will send me a letter from sharma the adminastrators saying they have authority to take over lifstyle claims is this true and who are ULL solicitors. We did not give authority to any of the two companies except lifestyle claims.

That would be really helpful - we're talking to the MOJ compliance Officer at the moment about this issue.

I'll send you a private message with my e-mail address if you could send the paperwork and also an account of the call you had from Redhawk.

                    Re: lifestyle claims ppi

Many thanks gdd - got it.

To answer your question about whether you have to pay Redhawk, we had this response back from the senior MOJ compliance officer for Redhawk:

''I am aware that Redhawk have acquired the consumer database for Client Connection in a pre packaged sale arranged by the administrator. Further details about this should be obtained from Sharma and Co. Redhawk are then contacting clients and obtaining new letters of authority, getting authority, pursuing the claim to conclusion to assist the consumer. This is for no extra up front fee. They are advising consumers to reclaim upfront fees as detailed above. It would therefore appear that the consumer will be entering a new contract as the previous one ended when CCL entered liquidation, but we would advise any consumer to seek further legal advice for any contractual matters.''

In other words unless you signed the letter of authority from Redhawk, there is no contractual basis for them to demand a fee.

                      Re: lifestyle claims ppi

I 100% agree with Exc - if you have not signed the contract which they sent you - then there is no contract for them to claim any money from you.

What I would like to know is how come they had access to your personal details and which accounts you had in progress when they only purchased a client data base?

I cannot wait to see Shama's detailed reply....of exactly what they sold and whether the data was protected under the data Protection Act.

even though barclays paid us direct into our account in dec 12. Redhawke are asking us for their share for something they did not do

                          Re: lifestyle claims ppi

Exactly they have no contract with you according to what the senior compliance officer at the MOJ are saying. We are still awaiting a response from Shama's and another email has gone today to the MOJ regarding cases like yours which we are not happy about the way Redhawk are trying their luck.

Your contract expired when Lifestyle Claims went into administration. Unless you signed the letter of authority from Redhawk (which would form a new contract between you) there is no legal basis for you to have any liability.

As Tuttsi said, let us know when you hear from the administrator. They have clearly told the compliance officer that they merely sold Redhawk the client database. But as Redhawk were aware that Barclays paid your compensation, it was obviously more than that and potentially a breech of the data protection act.
