Hi, Sorry didnt get as far as i'd hoped, I can't find the agreement, so i've asked for a copy. I did send a letter for SAR etc and I had a reply this morning from them as they stated in April of 2010 I am not the name on the contract so they will not deal with me thank you very much etc etc ill post the complete letter up later.

Hi there
I have not read through all your posts as such, but I understand you have already requested for SAR?
And sent off the reclaiming letter/questionnaire?
I expect your already aware of this, but they have 40 calendar days to comply with the SAR, when this arrives if you feel you have not received all the details you requested for then write back and give them about 7-14 days maximum to send (if of course the 40 days have passed), if they are unable to send - they should confirm this to you in writing, and of course if they are unable to send anything on your request they should write to explain and they should also return your payment made for the SAR.
In regards of the PPI reclaiming, they normally have 8 weeks to give a decision, but they may also write to request for more time, but also take into account of the Judicial Review that is currently on-going at present.
If they confirm they are unable to deal with your complaint by 8 weeks, they should also confirm if your able to take your complaint to the Financial Ombudsman Service (FOS).
You can download/print the complaints form from the FOS website, or ring for them to send you a complaints form, or you can even do this over the phone, but personally I would complete the form and enclose "copies only" of any evidence you may have, this includes the Loan Agreement, copies of letters you have sent on reclaiming and any letters received, this will save time later on.
So if the business your reclaiming from is involved within the JR, they will or should confirm this to you.
However, I see you have made a start going from the posts I have read up to now.
Going back to the SAR, I take it you have now posted this by signed for/recorded delivery?
This way you can keep an eye on the status of the delivery and keep an check on the 40 days.
Any problems within this department, you can contact the Information Commissioners Office (ICO) for advice.

If there is anything else you need to know, just ask, not a problem, I am back and forth every day.
I assume Turbo, Bill and Marshallka are dealing with the calcs side of this for you, this I cannot do, not a good subject for me in this department lol.

I also sent out a consumerse PPI questionaire to them.
I will get another letter out today also recorded, Asking about the charges and for them to break them down and all that. Awesome work here.
Ill post copies of the letters in the appropriate threads

--what was date of SAR btw?
--I'll get Di in here now on how to escalate this officially---but you need to be faxing the SAR on a daily basis AND ringing on a daily basis---to see why you aint got a reply--be more persistant than you have been PTD
--was it sent registered & sign for?
---also letter for explanation of charges in other thread--DO NOT have letters with both issues as lenders have different depts for Account Charges & PPI Insurance Queries-often in different towns & they regularly claim they aint seen info if you are not careful
---we are going to be more persistent now-aren't we PTD?

As I said in your other thread
I would like to see the agreement- and letters re increases etc cos your payments erratic
- and any statements that might precede those posted
- any letters you have cancelling insurance & their acknowledgement
TheseSAR/mis-selling letters letters btw are more important than calculating potential claim--- which can be done later

Ok--PTF--I'll check that link later---it just may be you need to be in the subforum for the specific lender under Bank Charges
In relation to your last question---if you are going for mis-selling PPI---I need your agreement to apportion your payments into Loan & PPI then add Stat interest to each part of the payment relating to PPI from the date you paid it
In simple cases, its just the PPI part of the Monthly Premium quoted on the agreement and can easily be done with pen & paper
However-when we have cases like your statements with different & erratic payments-we need to APPORTION each payment in the same ratio as originally detailed on the agreement
