        First of all I would like to thank everyone here for their informative posts.

        Can someone please confirm to me whether the court hearing last week was the actual judicial review or it will be decided if a judicial review is granted at a future date?

          It was both, ie whether it could go ahead and the grounds for the judicial review. Any judgement is subject to appeal

                We all know that the BBA will appeal, but the question is should the BBA win the first round will the FSA appeal?

                I certainly hope so.
                If you think nobody cares if you're alive, try missing a couple of payments.

                  We have to assume they will.....this is all assuming of course the judge grants leave to appeal, which he can withold.

                    Having said that, if the BBA win it means that OK the policy statement may be scrapped, but the BBA have hammered home the point that for such a review of past business the FSA should use a Treasury prder under s404 FSMA, which they now have. It would be irritating if the BBA won, but it by no means spells the end for PPI complaints. The thing that worries me is that the JR (from the reports we've had) seems to have turned to focus on the applicability of Principle-based regulation. I do not think that the judge should even entertain these argments, not least because they should be time-barred, but also because this was not part of the BBA's jr application and it would have a detrimental effect on so many mislead consumers if the judgement focussed on this too.

                    Let's just hope this gets resolved asap.

                      FSA warns banks not to delay PPI complaints

                      Banks have been warned by the Financial Services Authority (FSA) not to delay the processing of customer complaints over payment protection insurance (PPI).
                      The British Bankers Association is currently contesting FSA legislation over the mis-selling of PPI in a judicial review.

                        Halifax sometimes don't pay interest because the client been arrears and hence never paid off the debt accruing from the Halifax and so the most suitable thing to do to put the client back in the position that they would have been in would have been to just take away the PPI from the account. They do not give the 8 % because the client was never truly deprived of the monies because they did not actually pay it.

                        With loans the PPI is in-built as a set sum from day one, unless the client did not ever pay off any of the repayments so should be able to get the 8% ineterest back as well.

                          The warning about dealing with PPI complaints news is about a week old. It comes from the open letter that they wrote to all firms dealing with PPI misselling complaints. It doesn't add further to what we already know to be honest.

                            Very true Leclerc, there seem to be a lot of articles like this floating around at the moment. It's very frustrating because just when you think you're on to something new it turns out to be something you read 2 weeks ago!
