    4 way - Self v FOS v CMC v Sols

    I vote FOS in the first instance, Self via court in the second, if you are trying it on and werent actually missold and are just trying to get some money back off the bandwagon, then just FOS (not that i advocate bandwagonning at all).

      Maybe we could start a thread advising of how we could take legal action ourselves?

        We've always avoided that except on an individual basis (ie no templates) as it is different circumstances for everyone and I wouldnt want people who hadnt trueLy been missold taking a claim into court without going through all the facts first.

        The only thing i can recommend while considering taking court action as opposed to FOS is to go and dig up and read, read and read again, the court judgments which have been handed down of late. (I'll put a list together if you like)

          I second that. The litigation process is a mystery to me and what I fear most is adverse costs if it goes wrong. I'm sure I speak for many others.

            One of those involved was a 'PPI' ''specialist'' rather than UEA claims, theres threads and threads about them on MSE, and on here so I won't go into names.
            Never really heard anymore than was posted. I know that Guy was doing some "investigation" into it but as yet never posted back. It did seem like lots of new comers were on each blaming someone etc and I think that we will hear in the end. It was interesting with some names that came out on site though and some interesting PM's too!!!

                The Embarrasment Factor
                If your complaint is against the local branch of some bank or building society there is a certain amount you can do locally. Bear in mind that a local branch manager is responsible for the performance of the branch, and local reputation has a large part to play in that.
                The first thing to do is to try to get as high up the ladder as possible, as far as the branch manager; or at least the assistant manager. There's little point in dealing with the counter staff, who are probably just doing what they see as their job in refusing your request.
                If you cannot get through to the big cheese, or if you do and it doesn't help, try and interest the local newspaper in the story. They may well contact the manager for an interview, and even if they don't get one it will send a strong message.
                You could go into the branch at a time when there are lots of customers there and make a scene. Demand to see the manager. Demand your money back. Make a nuisance of yourself within the branch, within legal bounds of course. Walk up and down the pavement outside, carrying a placard demanding justice. If you stand still you could be arrested for obstruction (this is the case in UK law) but if you keep moving it's quite legal (don't write anything libellous on the placard, though).

                  Not quite the same buzz if you lose and have costs awarded against you tho, as many many people will testify particularly on UEA defences.

                  I still advocate FOS for PPI claims, courts should be, as intended, for last resort.


                  Couple cases you should be able to find the judgments for about the net, or at least reports on; will add when i think of any others;

                  Negative for the consumer
                  Blackhorse v Speak & Speak July 2010
                  Harrison v Black Horse July 2010


                  Positive for the consumer
                  Yates v Nemo - May 2010
                  Ian Wollerton v Black Horse Limited - 26 March 2010
                  MbNa v thouris - Sept 09 (on the PPI bit)
                  London North v meadows (2005 - ref total charge for credit etc)

                    It's worth listening to Martin Lewis give evidence to the Commons Treasury Select Committee this morning.

                    It's basically about financial regulation but he really goes off on one about PPI (at appx 9.52). When he'd finished, the committee asked him what he had for breakfast.

                              That bit is true. Something called reputational risk, however, you have to have a reputation yourself within the community for this to really work or have a damn good story that the press would be interested in, ie disabled but given PPI in spite of not being eligible(the idea of being taken advantaged of).

                              On PPI related issues they still have very little authority to do diddly squat apart from getting someone else to investigate it or even pass it onto the same department as you would have gone to anyway to look into.
