This question is for you bearing in mind your knowledge of court.
I have a complaint regarding missold PPI on 9 Loan Agreements I originally complaint to the bank and after my third letter they upheld but I refused their offer as it was well sort of my calculations and they only offered redress on 8 of the agreements.
So I refereed the matter to the FOS and after 18 mths they too upheld the complaint but they would not disclose what the offer from the bank was but still wanted me to sigh an acceptance form.
This I consider to be totally unjust and I told them so.
The adjudicator is now looking into it further lol
Being as both the bank and the FOS have upheld the complaint but im no nearer to knowing what the offer is so I can decide whether to accept or not I,m considering whether to now take this to court.
My question is what do you think my chances of winning are.
The bank will not take me to court for the outstanding loan amount because there is a 'vis a 'vis' and they owe me more than I owe them so are quiet happy to sit on it until my limitation period runs out.
They are now using DCA's knowing that this is with the FOS and is fairly disputed
Besides if they did take me to court they know I would counter claim.
This claim is quiet a considerable amount of money and has taken 2 yrs thus far
I would like to go to court with this but the barrier is the costs if I lose as it would be a fast track case as its well over £5000.
Could I take them to court with just one agreement via small claims to test the water so to say and if I win go back again with the other 8.
Any assistance you can give on a way forward would be much appreciated

`The offer detailed in the Co-op letter was an offer I put to them as this complaint was dragging on since July 2007 and I wanted closure it was a good offer which they accepted and duly send me a cheque for the amount outstanding after the other accounts had been settled.
Had they not agreed and thought I still owed them they would not have sent that cheque.
This is the problem with central banking the various departments do not communicate with each other and thus the consumer suffers.
That quite frankly is not good enough.

Hi PF, Its silly season for all of them not just Co-Op. They are now so desperate for cash they are picking up on "one or two" settled accounts and F & Fs it would seem, to see if you will crack.
I know you won't and neither will we. OH had another Final Demand from the fools in Hull today sent out after their tame legal tigers ( these cats don't even have thumbs) Nelson Guest sent it back to them telling them that no way would they meet our sols across a court.

Looks like I am now going to have to find out if these accounts were marked as satisfied with the CRA's and whether any adverse data has been added since the settlement.

Right, just as I thought this was all done and dusted the crawlies are creeping out of the woodwork.
As the letter below confirms this was settled both to myself and the bank but it appears that the left arm is not communicating with the right.
Hve phoned Mark Davis this morning and he confirmed that an email was sent to the collections dept by him instucting that the balance of the current account was to be written off as we had reached agreement and that the amount outstanding consisted of charges and would not be collected.
This was confirmed by them having recieved a cheque for just under £1200 which was the balance of the missold PPI being returned to me.
This morning I get though the post not one but two final demands from Lewis Debt Recovery this was relating to the charges that the bank had written off this is emotional harassment and the bank and Lewis are culperable.
Am now deciding how to play this it is interesting that they have sent two demands one address to my wife and one with no name on which is for me but they know that it is settled by me hence why they have not put my name on the demand.Last edited by pompeyfaith; 19th May 2011, 13:32:PM.

Guys,
It is really sinking in now how well we did, not only is a £6600 debt paid off in full but I got £340 in bank charges returned this is a second result on bank charges as I had £2700 returned in 2007 just before the court case.
I also had £1200 back in cash.
Both these claims have been resolved either just before or just after a court case.

Quite interesting that they did not further hold up my claim citing the JR but then was one of the first banks to be named and shamed over the next big rip off in packaged accounts.
And yes I had one of those from the co-op too since inception so looks like I will be after them again lol just as I thought my dealings with the Co-op was over.
