    I have posted on this elswher but what happens now?
    Still waiting for a reply from Welcome.
    FOS contacted today and say that they are still "behind" in srttlemet but they would require that we sign a "new aggreement" As they have failed to prove (after almost a YEAR) that the account exists on this address or on the number that we had.
    I have documents as a result of SAR frin last December that relate to a loan with them but address and account number are different.
    In August they admitted that they could not find any documents but tried to quote some sort of court case.
    Got a useful tool (posted elsewhereif you are a custoer of BT you can use the Chose to refuse service and provided you know the number can stop them contacting you!!! (out of seven number I have six of them are something to do with Welcome)
    Bit a smke screen I know as I have been following the antics of Cattles plc
    Doubt very much if we will get anything now!

    Got a letter from them today!
    They are still trying to say that we MUST sign a new agreement before they can "proceed" so we still wait...

          We will!
          Not going to sign anything until we take advice either from yourselves/ombudsman or citizens advice.
          They have, already told us that Welcome will have difficulty "proving" the account exists as we have never had any documnets regarding it since we moved house and the ones we have are a different number and address.
          Looking at other posts this seems to a comman line for them to take and recent news from the "owners" Cattles does not look good!:cry:

            I wouldn't expect anything anytime soon. Shareholders meeting on 17th should settle Cattles future one way or the other. If they think they'll be able to tap them for any more cash, they're going to be in for a very big disappointment.

                I have just come to that comclusion. the form arrived today and they have still added "acceptance" fees! Still no mention of anything from them other than in order to 2proceed" they need this form signing.
                Tried to contact ombudsman but phone is engaged alll day.
                Should we still wait or contct (Not) Welcome to say we still do not accept these terms.

                  I would keep trying FOS. Why exactly are Welcome trying to get you to sign a new agreement?

                    I do note that you may wis to receive specific refund figures at this stage. However, this will depend entirely on how many future payments you ake towards the oan aggeement. therefore, I am unable to provide with a specific refund figure until this peocess has been completed."
                    she then states that if we do not receive this documment we are to contact her and that is she does not hear from us within four weeks she will assume that the matter is resolved.
                    The form received is not signed or dated by them.
                    We made the mistake in 2003 in signing what now appears to have been a new aggrement as the forms we still have have a different customer number and were for our old address we have never had any documents for this address but still continued to pay until recently. A subject acess request last year contained copies of the documents we already have and contact sheet stopped in March the same year (no explanation about this)
                    By my working out we have payed them over £19K and the "new" form has a total of £17,745.40!

                      I think we need to look at your figures, how much was the original loan, ppi & interest ? when you did the DPa/SAR request did you receive statements etc, also do you have a copy of the 2003 agreement ? From what you said they don't have a copy which is why, as well as the recalculating the loan bit, they'll want a new agreement signing.

                        So is this loan still ongoing? I assumed, perhaps erroneously, that it was paid off and you were just reclaiming the PPI on it?

                        As Ame says, we need to see figures, preferably scans of all the so-called agreements relating to this.

                        Looks like I'm not the only one where there have been multiple account numbers for the same loan.

                          Will have to get them all together. do not have scaner but will do my best.
                          spoke to the ombudsman today and am sending them copies of the letter and form.

                            You could have sued for non-compliance of the DPA. If you send a reminder, you could still do this.

                              Would need to complain to ICO first really, Ame. Give them no leeway for argument.
