You said you sent a Subject Access Request last December. What information did you receive?

If you didn't receive anything or insufficient information was supplied, then you can sue for non-compliance and a small amount of money.

Tried to do this but just got yet another "complaint" number, However snce I have managed to stop them telphoning me lf is lovely and quite!
The ombuman now has copies of all the paper work we recived from them after the ppi (a year this week) This contined copies of the forms we had from our old address and two statements the first for that loan the other for the one we have now both appaerently havng ppi added!
the list of "cpntacts was a bit of horthand and stopped in march of last year.
They finally admitted in August that they couod not find the paper work relating to the second loan. yet in the "new" form they have still added acceptance fees.
Sorry for rambling guys its good to know I am not the only one to be in the middle of a dispute with these DIMBOS!

have you heard anymore from welcome as yet?... We still waiting with no luck altho we got letter today sayin they chargin us £10 for a default notice we have not recieved...... Me thinks they playin games again and another letter needs sent to them to remind them our account in dispute.
FOS already told tehm to stop sendin them to us and welcome said they were computer generated.....
They always have smart answer dont they......lol

They do indeed!
PPI is now on "hold" until such time that we "prove" the whole account is unenforceable.
All documnets posted ot FOS last Thursday....notng from Welscum

had (another) default letter at the weekend. Written to them AGAIN that it is still with the FOS.

We kept gettin default notices until we contacted fos about them and they suddenly stopped... until this weekend wen we got a letter about charges fro default notices.... I wrote back and told them I would be disputin them charges as well and they can whistle while they wait for payment to keep themselves amused coz it will be long wait.

It appears this loan may be un-enforceable. IMO I would CCA them now.

It is quite normal for the Firm to re-calculate a loan as though PPI had never been added to it once the FOS have upheld it. That is why they want you to sign a new agreement, nothing untoward there.

However, from what I have read here, they appear not to be able to locate this original account or give evidence of it and therefor it would be in their interest to at least recover the loan amount anyway. Naughty naughty but I would be going down the un-enforceable route by sending CCA request, you never know. Send that and lets see what happens.

You could still send CCA request while the FOS do their bit.

OK... which of the two Notttingham address's would I send that too?
And as i already about nine "compliance" numbers and two account numbers do quote them all?

Just looked at the templates, think I already did this?
Also did a subject access (a year ago now) but only got documnets for a previous propeerty and account number.
The last letter in July last year was a "financial stemnet" containing "key" facts thatwas "wrong" as whoever did that gave the interet rate as 1% ! (1% and Welcome I dont think so!)
Initially FOS was reluctant to help as it was over six months from the last "final responce" from Welcome but because of the delays with the PPI case have now agreed to deal with it but it may take a while!)

Just got our statement of account several letter charges.
Only "letters" we have had are the ones regarding the complaint and a very bad unsigned default one they have the cheek to charge for this?
Anyway back with the ombudsman will await developments!
