Halliwells' administrators seek funds to cover £200m of debts | News | The Lawyer


Failed firm Halliwells owes creditors a total of around £200m, a letter from its joint administrators has revealed.

BDO partners Dermot Power and Shay Bannon, who were appointed joint administrators of the firm last year, have contacted all known creditors stating that they have received unsecured claims totaling £191,521,921.

Martin Roberts, of Bolton, Lancashire, was found guilty of re-directing client monies into his own account and that of a fellow associates during his stint as a real estate lawyer in the firm's Manchester office.

As well as scamming clients,a tribunal found that he had also been stealing money by overcharging for Land Registry tax.

According to papers, seen by Credit Today, he had also sent letters to HM Revenue and Customs "knowing the content to be untrue."
Roberts’ activities came to light during a time when he was absent from the office due to ill health in June 2007.

Following an investigation it was revealed that he had sent an invoice to a client– housing developer Cliveden Homes – requesting for £22,000 to be paid directly to him. However, Cliveden Homes paid the money straight to Halliwells and on receiving the money the firm’s accounts department could not match it to any existing invoice.

An investigation discovered that Roberts had set up four files in the name of an acquaintance who was unaware of his activities. It emerged that he used these files to siphon client funds into bank accounts held by himself and a relative of the acquaintance.

Halliwells, which is on the verge of entering administration, successfully applied to a court to have his assets frozen when it uncovered his activities and a civil court ordered him to repay £70,000.

The Solicitors Disciplinary Tribunal said during the review: "The respondent's course of conduct was deliberate and carefully planned and the respondent acted dishonestly."

The Tribunal has ordered Roberts to be struck off the roll of solicitors and has been ordered to repay £12,231 in costs. The Tribunal said that Roberts conduct had been "disgraceful."

Halliwells had not responded at the time of going to press. Last week it emerged the top 50 law firm had appointed administrators after hefty property costs battered its balance sheet. The administrators are believed to be working on a sale of the business to rival law firm Hill Dickinson.

Hi everyone, long time no chat, have been busy

Have just stumbled upon this thread, as a result of a google search on the solicitors, I know Rich Burley from another forum, and met with him in December with regard to an accident that the other half had at work, as he does PI claims.

Last we heard from him was in January when he was given the go ahead to proceed with the claim.

I emailed them this morning, to receive an email from Shacklocks telling me that Burley's had closed down.

I do have another email addy for Rich, as well as a mobile number, but I am guessing that it's a waste of time, and we should find another solicitor?

Cartel customers face £30k court fees

Customers of claims company Cartel Client Review could find themselves further in debt to the tune of £30,000 after it has emerged its legal firm botched their court cases.
Court costs: courts fees can cost between £20-30,000 if a case is unsuccessful.

The firm working almost exclusively on Cartel's 'debt-free' cases, Consumer Credit Litigation Solicitors, was shut down by the Solicitors Regulation Authority last week due to concerns over 'suspected dishonesty'.
It has now emerged CCLS took four cases to a Manchester High Court before Christmas as part of 10 test cases chosen by a Judge Waksman to decide the circumstances in which debts could be deemed 'unenforceable'.
CCLS failed to win the cases for its clients and had costs awarded against them.

However, the solicitors did not have insurance in place to cover it in the event of a failed court case, according to a source at Manchester Civil Justice Center, which has details of all upcoming cases.

This means the indebted individuals who originally hoped Cartel would free them of their debts could now be slapped with further court fees of up to £30,000 each.
This comes despite Cartel customers being led to believe their initial fees were the only costs they would pay in the event of an unsuccessful claim.

Further cases are being held in Manchester presided over by Judge Waksman on March 24 and 25 to decide whether these costs should be borne by the individuals involved or paid for by CCLS. A judgment is expected shortly after Easter.

Also to note on here - please avoid companies who are offering 'RESCUE' packages for claims with Cartel. Have a feeling these will go quite public following any announcement tmw (or whenever).

Apologies if this has already been posted elsewhere.

"Interestingly" or perhaps not, this programme said a senior employee of Cartel was paid £800,000 during 2008/09. Just shows the extent of money involved- and shows the benefit of joining a community on line where you can get help, support and guidance for £zero.

For those people that have been caught out by CCLS collapse and who paid by credit card- please consider attempting to claim the up front fee from your credit card provider. (That is one potential route and there are others refered to earlier on this thread.)

You may have grounds for this as the service was paid for on the credit card and the service Cartel were supposed to provide was not delivered within the set timescale.

That could be quite ironic for many, if the claim CCLS were supposed to handle was against the same credit card firm that CCLS were paid with for their "service".
