    Wasn't there someone on here who's bank said that cos she didn't actually owe them any money at the moment, then she wasn't considered in hardship? Can't remember who it was now though, but I seem to remember she got there in the end. Think it was somewthing confusing to do with Abbey. I'll have a mooch round see if i can find it.

    I think they are trying to fob you off by saying they can't proceed becuase you started over a year ago. Hardship claims should be considered on the basis of your circumstances now, not last year or 5 years ago or whenever.

    Is Scooby on the case with this one?

      i was told They could not count me as hardship because I did not owe them and that was Barclays

        travel girl was the one that I think said her account was closed and she was refused many times but eventually got her charges back.

        Maybe we should be trying a few last letters on the ones playing hardball stating again the new terms of the waiver and asking for specific reasons why the claims are being refused. When we have the final refusals in writing maybe as a website we can contact the FSA or FOS for comments. I think EXC has some contacts?

          so should i wait for the letter of hsbc stating why they will not consider my case and then put another letter together but a bit stronger?

            Yes Killer, wait for the written confirmation and please post it up.

            Then we can help you put together an even stronger letter or advise what course of action to follow next.

            Until we can actually see something from them in writing it's difficult to really decide what is the best course of action.

                Hi KS

                My hubby has submitted all our hardship papers to HSBC, all they want to do is for him to speak to a debt councilor, so he is contacting the M F Geoghegan, CBE, Group Chief Executive. I happen to know that he intervened on another case recently on this site 'Jester' and the CEO organised a payout and speedily. Although he was a very severe hardship case so not sure if it will work for o/h, although we have been given harship status on Abbey and HBOS but hubby will have a good go in any event. He does not feel it the way forward to take a loan and does not like the idea that they will not put anything in writing and that you have to speak to them on the telephone only.

                Can only suggest that you write to him at Head Office as my O/H is going to at the weekend.

                    hi all recieved a letter from the court this morning about my stayed claim with hsbc please can someone advise QWICK i have only 7 days to appeal this.

                    for some reason i cannot upload the second page so ill just type it instead.

                    UPON HEARING the claiment and the counsel for the defendant

                    IT IS ORDERED THAT:

                    1. the present proceedings be stayed pending the final determination (including, for the avoidance of doubt, any appeals) of the commercial court proceedings between the oft and the defendant (and seven other banks) comprised in claim no. 2007 folio 1186.

                    2.both parties shall have liberty to apply.

                        Sorry I am confused.

                        I didn't realise you had actually started a court claim in respect of your HSBC charges reclaim.

                        When did you start this court claim?

                        This thread has so far been about writing what I thought were your preliminary letters on the basis of hardship for your Natwest and HSBC claims.

                        Did you send HSBC earlier preliminary letters and an LBA, which POC did you file with your County Court claim.

                        Your really should have given us the full story at the start of your thread.

                        You have the right to appeal against the stay that the Court wish to apply on your claim. But I would really like to understand what is going on here before offering any advice.

                          yes i began a reclaim for charges against HSBC about a year ago it got to the court stage just after the origonal blanket stay order by the OFT.

                          Im sorry im being thick your abreviations not sure what they mean LBA- POC.

                            LBA - Letter Before Action

                            POC = Particulars Of Claim

                            OK, so you started a court claim for return of your HSBC charges about a year ago.
                            Was the claim stayed as part of the blanket stay or is this the first you have heard from the Court regarding staying of your claim?

                            Is it possible for you to post up a copy of the POC that you filed with your court claim? Make sure you leave out personal details that could identify you.

                            Have you had or sent any other correspondance from or to the Court or from HSBC since you filed the court claim other than the recent hardship letter that you sent to them?

                              Ok my claim was stayed by the court s part of the origional blanket stay's.

                              I have tried to upload all other correspondance Budgie but i cant for some reason so im going to email it admin@legalbeagles.info if that is the correct address and put F A O Budgie hope this is ok.
