    You have a couple things NEED paying off don't you - why not act in advance and do a FROA (first right of appropriation) before the cheque clears to counter anything they may do. You need to say whats going in and what you need to be able to use to pay the essential debt then they should allow you to remove that money from the account first.

    Practise is to give 28 days notice to a customer before removing overdraft facilities, but they are repayable on demand contracts so I won't pretend the possibility isn't there although unlikely.

      They are supposed to give you notice when removing an overdraft, what I would suggest is the following.

      As soon as the cheque has cleared the account make the payments you need to immediately. Should they then bounce them then it is their problem that it has happened because as far are you were aware you still had that overdraft facility, i.e you had not been given the necessary period of notice that it was going to be removed from your account.

        Got a letter from Abbey today

        It refers only to one of the claims and does not mention the other claimk number at all

        In considering your case of finanical hardship, Abbey National Plc enetered into negotiation with you to settle your claim. Accordingly, we refer to your recent acceptance of our without prejudice goodwill offer to settle your claim in the sun of £3,327.98. We can confirm that payment in the agreed sum has been paid into your bank account and attach a deposit slip evidencing this.

        As agreed, payment is made without prejudice of any liability by or on behalf of Abbey National Plc and does not prejudice your rights under the FSA Waiver dated 28th July 2008, which may vary from time to time.

        Should you wish to discuss any aspect of the above then please do not hesitate to contact us


        Is ther anything in this i should be worried about??? Do I need to do anything else????

            YOUR CLAIM AGAINST ABBEY NATIONAL PLC: (then it quotes the case numer)
