      Has he hell!!!! I phoned him around 11 after i got back from the dentist and he said that my case was currenbtly being looked at and that I would definately have an answer by the close of business today and he would call me as soon as he heard.

      I didn't get a phone call, so the lovely Mr Coyle is definately getting ear ache on monday!!!!! If he hadn't heard anything he could have phoned/emailed/carrier pigeoned!! and told me that, so I wasn't hanging around in jitters

        I am getting so frustrated now I could cry!!!

        Have phoned Ronan again (I'm off his xmas list for good now!!) i got the same answer - it's with the hardship team, waiting for a decision, will call asap when he gets a response. He did say it was pointless me callign him and when he had an answer he would call me. i reminded him that 3 times now I was told by him that he would have a definate answer for me and 3 times that deadline has passed and my finanical situation is not improving with time!! 2 of times he actually told me to call back for an answer, so I was only following his requests.

        He told me it was poinless discussing anythign as he hadn't anything to tell me. I thanked him for his help and explained that I realised he was caught in a process and could only act upon information when given to him. As he was unable to push things along perhaps higher intervention was required. I asked who i should make a complaint to as i felt almost 6 weeks is excessive for a decision to be made. He gave me the number of the complaints dept (0845 600 6014).

        I rang them (i didn't press an option, just waited) and got through to a nice lady called Samantha - informed her of the situation and she then contacted the hardship team (ben) who informed her the case is with the legal team!!! I told her that Ronan was adamant that he had not had the case returned to him and that the hardship team still had it. She tried to get through to Ben again but he was away from his desk, so she has sent an email to Ronan and to Ben asking to locate my case and see who actually does have it and for them to conatct me with a decision. If I haven't heard by 3pm then she advised me to contact complaints again to see what is happening.

        Why do i feel when I try taking 1 step foward it's turned out to be 2 backwards into quicksand!!

            OMG OMG OMG!!!

            Ronan just rang!! Abbey agree we fit the hardship criteria and they are willing to settle one of our claims at 65% the sum offered is £3327.63 (which is inclusive of the CI interest!!!! :tinysmile_aha_t: ). The other claim will remain stayed until the court makes a decision (plus I also have one that is stayed at MCOL level but didn't mention that!!!). I can hardly remember all that he said as I was in such shock!! What I do remember him saying is that it is a godwill payment. He is raising a cheque and it will be paid into my account on Friday and should clear by the end of next week.

            There is nothing for me to sign (or at least he hasn't told me there is) and all that he said he required was verbal confirmation that I accept this a goodwill guesture as a valued customer of Abbey to help me in my time of financial hardship. I think I threw him a bit coz i just kept saying thank you - think I also scared the hell out him when i told him I could kiss him for giving me such good news!!! I think he was rather grateful to be phoning me and not in a face to face meeting!!

            This helps us out of a hole in so many ways - I can clear all my arrears and actually breathe easy and not dread the postman's delivery each day

            He also said i was the first one on his list to call - he has had a batch back, so will be phoning others - so BF I really really hope you are one of those hun and that you have the same good fortune I have had

                  It is for one of the two claims I sent in - orginial amount of the claim was around £5,200 and Abbey have offered a goodwill payment of £3,327.

                  The other claim remains stayed and will be dealt with when the courts decide what the next move is. I have another claim that is stayed but i didn't even mention that one to them.

                  So to summarize:

                  Claim 1 Goodwill Offer of £3,327
                  Claim 2 Stayed
                  Claim 3 Satyed

                  One very happy bunny in a very good mood!!!!

                  What do I do now - or at least when the payment is cleared anout out of my account!!! Do I need to notify the court etc, or do I wait until the court have decided what is happening with the claims and sort it out then???

                        Jen, I am shocked.

                        You have done bloody well.

                        You originally told us that the actual amount of charges relevant to claims one and two was only about £1600 and that there were not many charges on the third claim. I know you have had lots of charges since filing that third claim but I still suspect that you actually have less charges in total than the amount they have offered you as a partial goodwill gesture.

                        The way this has worked out for you is trememdously brilliant.

                        Don't do anything !

                        Don't discontinue any claims, don't write any letters or sign anything.
                        Just bank the cheque and wait for it to clear.

                        I still suggest that you combine all your charges onto one single spreadsheet so that we can really see what they have actually paid you against what is really outstanding and so that you have a benchmark to use going forward.

                        Very well done and good luck to you. I suspect that you must be over the moon with this result.

                            Its good news and will be without prejudice to the rest of your claim.

                            I agree with Bud that you should do a full spreadsheet for the account. When this comes to a conclusion I think the FSA or whomever will come up with a plan to refund charges plus xx interest/compensation and these payments now will come off any total that that is worked out at. Not sure how the courts will deal with stayed cases tho. I think we should keep an eye that the banks arent telling the courts anythings settled tho....just used to them being coniving I guess lol

                            And yep you needn't do anything letter wise - see what your letter with the cheque says - will probably be the same as the others so no worries on that score.

                              You are right Bud - the charges for all 3 are defiantely under the amount they have offered as a goodwill payment for the one claim. He was very clear that the offer was for this claim alone and the 2nd claim would remain untouched and not brought into consideration as far as the goodwill payment is concerned.

                              I was expecting about £1,000 if i was lucky - this is way beyond anything I had thought they would had offered. It is certainly enough to be able to clear all my arrears and give me a bit of breathing space.

                              Ronan said the cheque will be paid into my abbey account - I won't actually get it until it clears through my abbey account. I guess I will get a letter at some point telling me about the offer etc from Abbey - when i do i will post the contents of it here so we can make sure there is no nasty surprises in it.
