  • CCJ being passed on

Hi all. I wonder if you can help me with something. Hubby had a CCJ lodged against him for an old credit card debt with Egg, which was brought against him by Bryan Carter and is due to become time barred in August. We were in the midst of a terrible time and as such, he didn't end up going to the court date, so they also managed to get a 'caution' entry onto the title register of our home. He agreed to pay £30 a month, which he has been duly doing since the date of the ccj. We're hoping to move house towards the end of this year, so a few months ago we looked into how much was still outstanding and we're told that it stood at just over £4k. The original debt was only around £2.5k, but we didn't fight it in the beginning (stupid, I know) and it's too late to argue about it now. We had a letter from Bryan Carter the other day to tell us that they were passing the files over to Fredrickson (whom we believe to be a different arm of the same blood sucking satanic monster) and that the debt was now around £3k. If we continued to pay £30 a month, it would take us 8.5 years to clear it. If we weren't desperate to move, we'd probably just go with this option, just to pee them off! lol

We badly want rid of this debt, so that we can get cleared, get the entry on our title at the Land Registry removed and can get on with moving (although we're not going to tell them that!), so I have 3 questions:

    1) Why have they transferred our case from the solicitor arm, to the debt collection arm of the company?
    2) Why has the amount gone down by almost a grand in 3 months, when in reality we've only paid about £90
    3) What are the chances that they'll let us do a partial settlement?

    Huge thanks!

Probably the best way to get this removed from your property and enable the move to go ahead is to contact Freds and see if you can make a full and final settlement on negotiation with a consent order that they remove the charge/caution from your property. You might be able to do that for about £2k. Bryan Carter is a solicitors firm and Fred's is in house bit of Lowell - presumably the restriction is in Lowell's name ? Lowell are bringing things back in house at the moment after having set up their own solicitors firm so I don't think it will be connected, they are just dealing with things themselves more now rather than paying a third party.

Hi Amethyst. Thank you so much for taking the time to reply, I really appreciate it

The CCJ was in the name of Bryan Carter, but I can't remember who the restriction was filed under at the Land Registry - I should probably order some office copies of it to find out!

Do you know if many people have had any success with getting a full and final settlement at the end of a CCJ? Hubby asked the call handler a couple of months ago and they were about as much use as a candyfloss umbrella. I did wonder whether the reason that they were passing the case back to the DCA with only a couple of months left on the clock, was to pressure us into paying the rest off before their protection of the CCJ ran out... I'm kind of hoping that it is, so that we can use it to our advantage and squeeze them for a good F&F settlement. I hate these scumbag agencies. We had a big run-in with Lowells a while back, got a fabulous solicitor involved, settled everything, they've fallen off our credit files and they're STILL trying to chase us! 😡
