Hi all, I know your gonna shout at me but in a moment of laziness I went through the claims guys to see if I had any PPI, I didn't think I'd ever had any but thought it couldn't hurt to let them check, turns out I am owed about 400 from HSBC, I sent off the forms to the claims guys authorising them to take their 30% payment as it seems now they want payment before they will give me the forms from the bank to fill out to release this money, the claims guys have not taken there payment and its been over a month now, my question is were do I stand if I just write to HSBC and ask for a copy of the form and get the full pay out, basically I suppose I'm asking if I'd still be liable to pay the claims guys their fee if I cut them out the loop, also what is the likelihood of them chasing me for there fee

Just so I'm clear:
Has the PPI complaint actually been upheld by HSBC?
If so have HSBC themselves offered £400 in compensation?
What 'forms' are the Claims Guys saying you need to fill before the bank 'releases' the money?

Thanks for such a quick response, yes HSBC have upheld my claim, I have a photocopy of a letter they have sent to the claims guys confirming they will refund me just over 400 once I have returned a form to them and gone into a branch with identification, the form HSBC have referenced in the letter is what the claims guys seem to be withholding from me until I pay them their fee, I'm not home just now but when I get home I can send you a copy of the letter from HSBC

You could ask HSBC for another copy of the form as you haven't received it.
I'm just checking their terms ( http://lbcompare.co.uk/services/mone...e-claims-guys/ ) as I'm pretty sure the fee is taken from the refund AFTER the refund is given at the the point of refund, NOT pay to receive it.#staysafestayhome

f. Compensation may be used by a Company to reduce any outstanding debt You owe
them and You understand that TCG’s Fee of 30% + VAT will be payable to TCG based on
the total amount of calculated Compensation even if the Company does not pay the
whole sum of the Compensation to You in cash. TCG will invoice You for the Fee which
will become immediately due and payable by You to TCG.
g. If the Compensation is paid direct from a Company to You, TCG will invoice You for the
Fee which will become immediately due and payable by You to TCG.

Ok it looks like you'll be paid directly by HSBC. I'm not sure it's worth arguing the toss over the contradiction in clauses (e) and (g) in the terms to be honest.
The requirement to pay the commission up front is a bit crap as it could take a couple of months before you get your compensation.
The letter you had from the Claims Guys does at least give you the option to discuss alternative payments arrangements if you can't afford it.
I've asked the regulator for their view so hang on till I get a response.

Hello I'm following this thread, today I received a call for Barclays to say my claim has been successfull and I'm due back two cheques for a combined total of £4536 and the said I will receive the cheques within the next 10 days. Now going by the link above the Claims Guys will want a fee of around £1632 is this about right? The only thing I'm worried about is if they phone up demanding their fee before I get the cheques as I won't be in a position to do that. I didn't expect this much back but that's a lot of money in fees to pay back TCG suppose it's my own fault for not doing it myself but then again I probably wouldn't of claimed.

Are Barclays going to send you the cheques without having to submit a form via Claims Guys?

Yes it is £1632.96
Urghhhhh, but yes, that's the price you pay for not doing it yourself.
If Barclaycard are sending the cheques directly to you there's no reason why The Claims Guy would claim the fee from you until after you have received them. Barclaycard will be in communication with the the claims guys though so they will be aware your claim has been successful, so it's up to you if you pay them that sum once your cheques have cleared or put the amount aside and wait for them to ask. If they do ask for in advance, then tell them you are unable to pay it until the cheques have arrived and have cleared. I don't like the way TCG hold people to ransom when accepting an offer expecting payment before the claimant receives the money.#staysafestayhome

I had a provisional response from MOJ, just waiting on a more definitive one. The CMC guy I normally deal with has moved to personal injury (lol)
My take would be that it is a contractual issue and is not uncommon for CMCs to put this in the pre contract agreement, however, there is still the requirement for CMCs to be fair and reasonable so anyone chasing for payment when the compensation has not been received as yet may be seen as being unreasonable.
I hope you should get a response from the Financial Claims Team but if you don’t, please let me know and ill chase it up for you.

Yes Barclays said the cheque were posted out today to me. But allow up to ten days for them to arrive.

Yes I don't have a problem paying them I just wanted to make sure what amount I would be paying them back. I will pay them when cheques are cleared thanks for your help.

Well if Claims Guys start hassling you just say you're not in a position to pay it until you get the cheque and it's cleared. Also refer them to clause (g) in the contract. There's not much they can do in reality.
