    My neighbours have just returned from holiday, informing me that a letter of mine was posted through there door...I opened the letter to discover its from county court buisiness centre.

    It's for a catalogue I took out in December of 2011 with very.

    Hi welcome to LB.

    Have you acknowledged service of the claim? If not so now using MCOL ( Money Claim on Line).

    Next a CCA Request to Lowell with the £ 1 statutory fee ( Postal Order endorsed for statutory fee only) get proof of posting or use signed for post.
    there's a template in the forum library.

    A Request under CPR31.14 should be sent to the solicitors ( template in library) for the documents mentioned in the particulars of claim. (no fee)

      Hi and welcome to LB

      Oh dear, just what you want when you're just back from holiday.

      Below are the first steps to take upon receipt of a claim:

      So, first steps (within 14 days of receiving the claim)

      1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
      You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

      2: Send A CCA REQUEST to the CLAIMANT ( see here )
      This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


      3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

      This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)
      So you start by acknowledging the claim which you can do online, saying you intend to defend the whole claim but don't tick the box about contesting jurisdiction (a lot of people have been doing that). You'll find full instructions here: http://www.legalbeagles.info/forums/...313#post499313

      You'll then have to send the letters linked to above. Looking at the particulars of the claim, on the CPR request you'd ask for a copy of the agreement and the notice of assignment as they don't mention anything else and you can only request documents mentioned in the particulars of claim. :thumb:

        I've drafted letters which I'll post recorded delivery tomorrow.

        I've just acknowledged the claim via there website.

        I've now been asked to provide my defence, so I wait 7 days to see if I get a response or shall I file a defence now?

            Thanks again for the advice.

            I've done as adviced and sent a cca to lowells with a £1 postal order included and a cpr to there solicitor, I've sent them both recorded delivery.

            I'll keep you informed of any developments.

              I've just received a response from Brian Carter solicitors? It states.....we write further to your letter dated 23 October 2015.

              We can confirm this matter will most properly be allocated to the small claims track as this is a simple contractual matter and part 31 of the civil procedure rules will therefore not apply.

              In any event the notices of assignment left the control of the claimant when they were dispatched to you.

              It is the original creditors policy to issue agreements at the start of the contract and statements throughout the duration of the agreement and, in this regard, we ask you to refer to your own records.

              We confirm our client is not agreeable to an extension for filing your defence.

              We recommend you seek independent legal advice.

                It is a standard letter and nothing to worry about. They hardly ever send any documents out (and it doesn't go very well for them in court ) You have a CCA request in with the claimant as well ?

                      I've just tried to login to money claim to start my defence.

                      I just keep getting a message saying user name or password incorrect..I've entered them time and time again only to get the same message.

                      I've tried ringing but no-one is answering.

                      I'm panicking even more thinking I didn't acknowledge the claim properly or something.

                        Just to update you, I filed my defence. Then waited 29 days from the date my defence was served on Lowell, upon contacting the court they informed me that a stay was placed on my case on the 9/12/2015.

                        I've still not had anything from bc or Lowell so should I continue to wait?

                          Lowell has failed to respond to your defence and the court has of its own volition
                          stayed the claim.

                          This is in all probability down to the fact that they have nothing to send you!!

                          You do don't need to chase anything now,

                          After the holidays check with the court again.
