If not received do not chase the CCA request. 7 days prior to the mediation appointment if still no docs contact
the mediation service and tell them.

It's seems that way, unless they are keeping hold of it until the last minute?

Hi nemesis45
I still haven't received any documentation from Lowell or Carter.
You mentioned that I should phone the mediation 7 days before to inform them of this. Sorry to sound a bit dim, but did you mean 7 working days (so that would be weds this week 20th: mediation booked for the 29th) or 7 days before (Friday this week the 22nd).
Thanks in advance
G

Morning nem,

I received this email from the mediation service after I mentioned I haven't received the documentation from Carter

"Thank you for your email. Unfortunately as we only deal with arranging mediation appointments we would be unable to prompt the claimant to supply you with that information. One of our pre-mediation checklist questions asks parties if they have the necessary information to be able to mediate. Due to the fact that you do not have this information, and you state you are only available from 3pm onwards on the date we have provisionally booked an appointment for, this case is not currently suitable for mediation.

What will happen next is the case will be transferred out to a local County Court and be reviewed by a District Judge. Please await an order from the District Judge outlining instructions on how best to proceed.

I hope that this is of some assistance, but should you have any further queries, please do not hesitate to contact us"

So I take it the mediation has been cancelled?!

What should I do now?

Best regards,

G

Without the documents being in your possession the mediator cannot continue an appointment.
You will now get directions from the court quite soon.

Time now to get your witness statement in order in order.

The debt remains unenforceable until the agreement is found.

Thanks for your help nem.

Will the witness statement be a copy of my defence or will I need to add in further information?

Hi hope you are well.

I received the court papers attached today.

I'm concerned about the section on mediation. I was told it wasn't suitable. Should I ring them and ask them if is suitable?

Sorry for the delay in replying G-man been away.

The WS is your statement of the events leading to this debt
being subject to a court claim. Take a look at some on the threads in this forum.

As to mediation if you don't have all the documents that the claimant intends to rely
on in court a mediator will decline to go forward.
