    Hi i sent a letter to BC requesting documentation in regards to a letter of claim i recieved from them. i received the letter below back. Any idea's what i can do next?

      Do you recognise the a.c number and is it a current account overdraft or loan or credit card account?

      Have you actually had a formal court claim or just a pre.action letter?

        Its for an overdraft. Ive only had the letter of claim from BC. Nothing from the court yet..!!

          There is no actually " credit " agreement for a current account/overdraft, a letter of " facility" is usually issued.

          Did you received " Demands for Payment" and A " Final Demand|" for repayment of the OD in full?

                Sorry for any delay in replying is been a very busy few days all round.

                Does the account show on credit reference files?

                To Carter,
                I suggest a " prove" style letter along the lines of:

                Ref: use Carters:

                Dear Mr Carter,

                Thank you for you template letter dated ......................: in which you refuse to disclose the documents that your client will seek to rely on should this matter proceed to a court claim.
                It is irrelevant what may or may not have been provided by the original creditor at any time in the past.

                I seek proof that Bryan Carter LLP and it's client has the appropriate documentation and authority to progress this matter further.

                If Bryan Carter fails to produce the requested information within 14 days from the date hereon I shall consider the matter closed.
                This letter will be provided to the court together with the template letter received.
                OK send that to Carter.

                Amend the above and send to Lowell. FAO Andrew Bartle Chief Operating Officer The Lowell Group.

                      Hi g man,
                      I have fought this lot for a great deal of time. Despite all requests of evidence to "prove it " (true copies, etc ) I got nothing. I am sure you are sending everything recorded /signed for delivery and take care with your signature as I have evidence of this been copied and not the same as the original credit agreement. I basically want to offer you support and advise you not to give up. My court date is no longer as they have just discontinued the case on receiving my defence. This company play a cat and mouse game, they purchase vast amounts of alleged debts hoping that by putting the frightners on people some will pay up. My partner was about to pay up to get them off our back, despite the account being Statute Barred and fraudulent. I am a stubborn goat and will fight and defend my rights. There are some good and wise people on this site that will help and offer good advice. Hope all works in your favour. Regards Moll

                        Hi Molly,

                        The allegation of " signature lifting" or forging is some thing
                        that if proven can a serious impact on the perpetrator and
                        should be reported to the FCA as " information" together with
                        any documents proving the allegation.

                            and if you are worried about it, an anti-tamper strip on the letter should ensure it doesn't happen
