Yes it is definately for an overdraft. Ive had a look at the account number. It appears to be a combination of a sort code and account number. Although im not 100% sure if it the correct number as the account was closed sometime again.
I will acknowledge the claim online today and send the two letters out too.
    Thank you for your help.

Ah, yes. That would make sense, 8 digits for the account and 6 for the sort code. However, THEY don't seem to be aware it's an overdraft because they refer to an agreement regulated by the CCA so do send the CCA request. Will be interesting to see what they respond with, these guys never have any paperwork, it's not the first time Lowell/Carter make that mistake.

        Will do just that!
Can you please confirm exactly what i should ask for in the CPR request, as you are aware i have sent 2 seperate letters requesting the paperwork before this claim was issued.
I just want to make sure i ask for the correct documentation.
        Many thanks.
        G

I have just re-read your post about the CPR and you have already told me what to send..!! Thank you

Re: brian carters letter Help needed..!!

In your CPR request you can ask for copies of:
          1. the credit agreement
          2. the notice of assignment
          3. the default notice

The CPR request goes to Mr Carter (no fee required). He should respond in 7 days.

          EDIT: Posts crossed.

I have completed the acknowledgement of the claim. I have checked the boxes which said dedend claim and contest jurisdiction.
I hope that was the right thing to do??!?

My next question is what do i do next?

            Thanks in advance.

Un tick the box Contest Jurisdiction unless you live in Scotland or N. Ireland.

Ring Northampton CCBC and tell them what's happened.

You'll need to ring their helpdesk, but make sure you say you only want to acknowledge service and not submit a defence just yet. :thumb:

                              Hi guys,

I have sorted the error with the court.

Any advice on my next move?

Have you send the CCA and CPR requests? If not, it's time to send them. If you have, then it's just a waiting game. :ranger:

No need to chase the CCA request, will be interesting to see whether they actually know what type of account this is.

They should respond to the CPR request in 7 days. I can almost type up what Carter's response is going to be but I'll save it for when you get it from the horse's mouth.

Do post up as soon as you hear anything. Bear in mind you still need to submit your defence a maximum of 33 days from the date printed on the claim form even if you don't receive anything from them. :typing:
