The main difficulty xino is that a Claimant always has the burden of proof. The onus and pressure is on them from the get go.

Defending a claim is different because the legal dynamics are different.

As EXC has said in the Small Claims Court the "winner" cannot recover their costs from the other side unless they (the other side) has acted unreasonably so the DJ order costs on an indemnity basis.

You'll find that some solicitors do offer No Win No Fee in the Small Claims Court.

Never underestimate the power of social media. Why not start a Facebook page (maybe you already have) to attract as many people as possible who have suffered a (perceived) financial loss as a result of this Train2Game issue.

This thread is called "Cabot Financial/Train2Game" so have you (or any other LB member) been issued with a court claim for non payment of a Train2Gain contract/credit agreement?

Sorry I haven't read back through the whole thread but I wanted to dispel the myth that solicitors don't offer No Win No Fee for Small Claims

I just want to be claer. do not bother with the FOS. they havent got a clue. my adjudicator even said she is not qualified.

they are on the business side. do not use them their judegment is worthless and they use misrepresentated language and false ness that dont add up.

they are liars and keep you waiting unecessarily.

one rule for them and another for you.

they are un qualified and specifically say. waste of time and energy.

it doesnt matter how much eveidence you put forward, doesnt matter about how much refernce or work you put in to give them the facts, they are not interested in doing their job. they are bad bad people.
to be refered to them is mis direction. gp straight to court.

I have waited along time trying to follow their system only for them to not be qualified in making a correct jusdgment.
i am not after the money i am after justice for the mis selling, mis information, bad course etc of what they have been forcing on me and the fos are part of that.

can i put in a request that does anyone want to give me evidence against train 2 game, witness statements, examples, letters, anything that is evidence on how they have mis sold, even personal sotries.

I waited 3 months for the fos to trace up barclays and clydesdale.
they never replied, the fos did nothing.
then a second application and in 2 weeks i traced it up the next day she replies.

nothing they can do to these companies.
it is biased against the people.

I worked my damndest. the rubbish game engine they give their rtists never worked.
I got it to work, i worked with the developer to sort it even added some features.
but that is all meaningless . i need a solicitor otherwise .

I'm trying to link every name associated with this company and every bit of info they promised.

So I looked into this Robert Ager http://www.collativelearning.com/SKI...%20REFUND.html and I watched his video.

I've seen that the financial company 'Careers Development Finance' (originally called B.S.T Credit Limited) had the exact same address as Train2game at one point. I believe it's a PO box now.

there are several training courses via the same company using very generic 'train4' or 'train2' names. Train2game Train4tradeskills. originally known as Scheidegger or Metropolitan International Schools limited and then Skillstrain

I've just found this video on youtube of someone being interviewed for the course. you might want to watch it before it gets removed as this is a company that tried to sue google twice and lost https://www.youtube.com/watch?v=IJdzYGtPHrQ

try finding where they say 'internships are given after completing section 2 of the tiga diploma'.
or that they will help you with career development.

I am being fed that they didnt promise career development -BUT WHY the hell would you do a course?????
also the train 2 game forums, when i was on the course, had many forum posts and thread of talking though the proceedure, yet they have all ben deleted.
the only documentation i can find is if you pass your tests with an average of 88%. even this doesnt garuntee.

you can see why apathy depression listlessness sets in and you cant be bothered studying for what?

also are you or any other students interested in approaching a solicitor en masse?
because after the fos splitting my application from another student i know some sneakiness will get in the way. just like everything to do with this preventing me from working.

I was also offered work experience and I was told by the salesman that 'seeing as you have to sign a gagging order when you start working at the placement, they'll just give you the job anyway so you don't end up telling anyone' but annoyingly I can't find it down in writing.

I too am in the same boat. I was subject to a 5hr hard sales ordeal. I actually applied for a job testing games. The same evening a saleswoman turned up at 7.30pm managed to sell me a tester course and even got my wife (who's an artist) to sign up for an animation course. We have everything ever sent to us. I haven't even logged on or started to course in any way, (my wife has spent hours and hours and a lot of money on upgrading our pc and stationary) after waiting for the course material to arrive I looked through and decided it wasn't for me. They say you have 2 weeks to cancel but I didn't get the materials until week 3. I've been paying this for years now at a massively reduced rate. I have requested that they cancel the course due to aggressive sales and false endorsements, the course is useless really.
If anyone can help me out I'd be forever grateful.
I have looked up the collative learning Mr ager video and his website. I am utterly out of my depth here. I have also notified my local trading standards but I've heard nothing from them.
I can upload anything you want I have almost everything including the glossy dvds they get you to watch.

Write everything down, off the Robert Ager video, regarding sections 5-7 of the consumer protections for unfair trading regulations, 2008 breach of contract, the supply of goods act 1979-82 etc, and they will cancel, the course also threaten them with taking them to the small claims courts. And ask to get a refund of all money back, if they do not cancel the course, take them to your local, small claims court.

Does this mean you've agreed to a Discontinuance of your claim which was due to be heard in court in a few days time?

If so I hope you've asked them to pay your costs as part of the settlement. A LIP can charge £19 per hour.

In the very least you should get your hearing fee refunded if you inform the court seven days in advance that the hearing is vacated.

Had the Defendant instructed solicitors or did you settle this direct with the them?

Just got my, small claims court, hearing on the 9th November so fingers crossed
