Ok now I am really well and truly narked off! I have just received this letter from Link. Does the judgement of a court mean nothing to these people?

I have just phoned Derby County Court who are not aware of this. The woman I spoke to said she would make a note on their records so that if we send payments to Link, Nemo will not be able to say we breached the order. However, she said once Link have informed the court that they now own the debt, they will be able to put us through the courts again in an attempt to reclaim the full amount. I really wish we could afford the fees to go bankrupt:tinysmile_cry_t:

I would be inclined to send a letter to Nemo, copied to Link ( or vice versa), basically saying

Dear Idiots

I refer you to case number xxxx which was heard by DJ Judgy in xxx Ccurt on xxxx. A copy of the judgement is enclosed for you attention. Any variations on this order must be imposed by the Court, not you numpty types who seem to be quite good at intimidation but not much else. I will continue to pay £100 per month unless instructed otherwise by the Court.

And if they now own the debt you should get an assignment notice from Link. Just because Nemo have asked them to administer and recover it doesn't mean they own it.

I sent a letter to Nemo, along with their cheque (which they have cashed) basically telling them that I will continue to do exactly as the judgement states until the court tell me otherwise.

This morning I got a threatening letter from Link claiming that I had breached the court order by not paying up by the 2nd of the month (the court actually ordered the 9th methinks). They say we now have to pay the full balance (******s) by return of post. The interesting thing is that my envelope also contained the same letter for 4 other Nemo "customers". A breach of the Data Protection Act for sure. Do I now return the letters to Link, or should I post them on with a letter from me encouraging them to take action under the DPA? The are threatening us with bailiffs too so I want to give them as much poop as I can without jeopardising our position, if that makes sense at all?

Dickheads.

Yes you paid in the terms of the judgement if you paid before the 9th so they can bog off, basically.

Send the letters back to Link, don't forward them on to the people concerned, but you can complain to the ICO as obviously you have concerns that they might send your info out in this way, copy a copy of the complaint to Link as well with the returned letters.

Send them a copy of the judgement too showing the 9th as the date and tell them to sod off, nicely.

number 4 sounds like the dentist lol.
