    Well finally I have another update.
    This case is still with FOS, well the PPI part anyway.
    Seems they have closed the charges part, but I haven't seen the final outcome.
    Need to chase that one up

    Just spent a good hour on the phone with a FOS guy that basically comes down to the fact HFC are claiming they have destroyed the PPI paperwork.

    Opps, says I as I have copies in my SAR.
    No matter, it's being passed up and I'll be sending bits over to confirm my position.

    To top it all HFC have decided to pass the entire "debt" to my fiends CapQuest.
    Guess I'll be calling them later with the good news

    At this rate the clock will run out before anything is finalised.

        Well yes and no.
        FOS still messing about with the charges side, but there has been movement of the PPI.

        Now this claim has both PPI on card and PPI on loan.
        When we originally looked at it I was advised that the FOS couldn't do anything with the PPI on the card as it was covered by the Leaseing and cobblers lot, ie before the FOS had authority.

        BUT they have now changed their stance and have taken on my PPI on card as a lead in a group action they are looking into. So all good there then and potentially huge...

        CapQuest, well they are history, ran orf when they found out this matter is in the hands of the FOS.

          O.K. thanks., Curly, battle with HSBC still going on , they sent SAR but no CCA copy as I asked them pointing out not under sec 77/78, so looks like I have to find your CCA request letter and look to amend under cputr 2008. Hope all is well your end.?

            ill put in my pound of lesh

            if an agreement is incorporated into another, or use another loan to pay of the first

            dont you need an agreement to modify the first as they are gov under the cca 1974

            WAS THAT IN THE SAR

            AND THAT BOTH PARTIES HAVE TO SIGN

              Not as such, but the final consolidation loan, to pay off all preceding ones, is limit usage loan.
              So there isn't a modification as such..

              This isn't even about technicalities of CCA, as yet, still going through the reclaim motions.
              At the end of the day THEY owe ME about a k or 2.
              I gave them the option to walk away and call it quits, but they insisted on playing silly sods..

                This gets even better.
                So the FOS are still investigating the PPI issues on this affair.

                CapQuest ran off, but I received a nice letter from some old friends this morning.
                So who do you think has been handed this hot potato now ??

                Put it this way it made my day and even got a laugh from the wife..

                            HFC must be desperate if they think empty threats from these "people" will cause me undue stress..
                            I guess I'll be adding this to my FOS and FSA complaints..
