      Well, well well. seems like Eon just don't want me to pay them.

      Just rang to get correct adress of where to send letter. Helpful woman says its nowt to do with them, i've got to contact the DCA. Explained that DCA have basically stuffed it, so I wanted to deal with Eon direct. She put me on hold while she spoke to DCA, as apparently the debt hasn't been passed back to Eon yet. Then gives me an address for Agency Liasion, 190 London Road, Rayleigh, Essex and says I need to write to them. A quick Google search reveals this is Eon.
      Didn't seem to grasp the facts about abuse of process and that Eon will never get any money unless I offer it to them and they deal with me. One interesting thing was that she did confirm that the debt was actually sold to TDX (or whoever). And apparently after 12 months if they have not recovered it it gets passed back to Eon.

      Soooo, do i write to the address in Essex, or should I send it to Custoemr Services just to prolong it a bit? Or should I be really naughty and send a similar letter to Bryan, saying
      "Hi, I know you stuffed it but I'm prpared to give you one last chance to redem yourselves and offer 20%"

        Don't offer Mr C anything, he doesn't deserve it, same goes for TDX as it was them that farmed it out.

            So its a toss up between the Agency Liason mob in Rayleigh, or the Eon UK Headquarters in Coventry, or the Customer service director in Warrington which is the address shown for complaints on my bill but doesn't seem to exist on the Eon sites addresses. Or even, from Eon's website (this address is also shown on my Powergen bill, as Customer Service Centre..

            Cheers Sapph. If indeed thats where its got to go, I'd rather send it to you for hand delivery then at least they couldn't deny ever having it!

                right, have decided to send it to Rayleigh, unless anyone thinks otherwise? On the other hand, why should I liase with their Agency liaison, surely its there job to liase with me?

                So am sending to the Nottingham address. They will probably have absoluteley no idea what to do with it. Shall we start a sweep on how long it takes to get sorted now?

                      Finally posted the letters, to Nottingham and Rayleigh, cc'd to each other on the bottom. Lets just wait and see now. Didn't mention Supreme Courts, thoght that they couldn't get the gist of County Courts, so Supreme would probably go right over their heads (not to mention mine)

                        Thank you for your letter dated 15 July concerning your recent court case.

                        Your letter has been passed to our legal team who have advised us that the action discontinued prior to the defences response. I have been advised that the action will continue on your account which will ultimately result in another court case.

                        Therefore I am unable to accept your terms of settlement. You will shortly receive a summons to your local magistrates unless the balance is paid in full to E.ON or a payment arrangement set up with the respective debt collection agency.

                        First thoughts (apart from to correct the grammar) are

                        Surely its not the fact that it was discontinued before my defence was received? its the reason for the discontiuance that counts. Don't remember anything in S.35 about discontinuance before defence or not?

                        Magistrates court???

                        perhaps they would advise me which bunch of clowns/debt collection agency are dealing with it? presumably they mean Mr C. Who I have had no further contact from.

                          Sounds like E-Ons internal legal team from that letter - maybe give them a call to get direct contact details?

                            last time i phoned they wouldn't put me through to the legal team. Might give them a call to get an address I can write to direct, then compose a suitably worded letter, with your's and CB's help of course.

                            Am talking to a very nice bloke, who tells me all the computers are on a go slow..........Faud Bhatti is not in this afternoon but I am reliably informed he's a very nice conscientious person. Oh goody. Pointed out that his grammar leaves a bit to be desired, nice bloke on end of phone says he will take that forward as it's a subject they've just been discussing......keeps apologising for computers..........gives me an address in coventry to write to......mark up envelope Head Office Complaints........tell him it's not exactly a complaint but never mind.........

                            So will compose a suitable letter to Faud, and copy it to coventry (or the other way round) and see what happens. Will post letter on here when I've done it, for suggestions and alterations. Won't be till tonight though probably, boss due back any minute, and am at work tongiht till 10, but bloke is going to the dogs on a freebie so should have peace and quiet when I get home

                                My defence posted special d 3rd July. Received by Court on 4th. Their discontinuance was dated 2nd July, posted to me with a lettter dated 3rd, received by me 5th. Court marked it as discontinued on 4th. So Bryan must have decided to discontinue on the strength of our letters to them dated 12th and 20th of June.
