    but how can I defend it when I do actually owe it anyway? Or shall I just cross that bridge when I come to it and hope Bryan folds before then? Will need major help on my defence CB.

    Haven't had a reply to my letter yet, its showing as delivered but no electronic POD available. And no reply to my email to the Fredpay website. I suppose i can use this in defence.

      The main thrust of your defence is Mr C's unlawful POC.
      He is clearly breaching the County Court Act.
      Also they're purposful ignoring of your reasonable request.

      After all how can you properly defend if you don't have ALL the relevant facts ?!

          Good stuff Wends. you are not tied to defending in full btw just cause you put it on the acknowledgement but it should still put a wibbler in Bryans basket when he gets the confirmation.

          Lots of these types of claims are tactics rather than law.... its not right but its how it is.

            Had a reply from the lovely Bryan.

            "thank you for your recent communication, however we need to discuss the matter further with you. Please call our office on xxxxx. the account has been placed on hold for 10 days. Please note that further action may be taken if you do not contact us immediately".

            Fail to see how they can place it on hold as they've already filed at court! Should i mention this when I phone them?? Should I phone them at all? If so, can i have some suggestions what to hit them with in the phone call please.

            gotta go out now, will check in later.

                Write him a letter thankyou for your message please be aware we will only communicate with you in writing etc etc. Don't mention court or anything just a simple note like the rubbish pants they sent you will do fine. Just make it clear you won't be discussing anything on the telephone.

                  REQUEST FOR INFORMATION UNDER THE CIVIL PROCEDURE RULES.

                  Dear Sir/Madam,

                  Thank you for your letter of xx/xx/xx, the contents of which are noted.

                  With regards to my previous letter, a copy of which I include for your perusal and ease of reference.
                  I have made a formal request for information under the Civil Procedure Rules as you have initiated legal action against me.

                  This information should be readily forth coming as set out under CPR 18 you are required to furnish me with any and all documents that you intend to rely on in court.

                  Any attempt on your behalf to obstruct my legal rights will be brought to the courts attention as you are attempting to denying me the opportunity to file a full defence and counter claim, as well as frustrating proceedings.

                  Further to the above, please ensure that any contact by yourselves is made in writing only to the above address. Telephone calls will not be accepted or made and viewed as harassment.

                  I expect your unconditional response within 7 days.

                  I would appreciate your due diligence in this matter.

                              I just want him to give up, accept the offer and discontinue. Don't suppose he will though, not without a fight. TBh I'd pay the full amount as long as the case was discontinued, the main thing is can't have a CCJ.
