      Seems as though they can do it going off this I found

      I raised the issue of Dormant Company status with Companies House over another DCA called Triton which is a part of RBS. After quite an investigation Triton proved to Companies House that they did not in fact employ staff themselves, or pay for any of the operations down to the last paperclip, it was all paid for by RBS. They therefore had no accounts or trading records, did not raise invoices or pay any so, could declare themselves as Dormant for accounting and reporting purposes. Brings a whole new meaning to the word 'Dormant' doesn't it? Nonsense if you ask me, but technically they can do it. I suggest before anyone gets too carried away with Dormant Company status they check the whole gambit out with Companies House first

        LIABILITY OF AGENTS


        If you act as an agent for the catalogue company and sell goods or collect money for the company you need to be careful. You should create a separate account for each of your customers. If you do not do this then the catalogue company may hold you responsible for any payments missed by your customers.
        ADVICE
        As long as you set up separate accounts, you, as an agent, should not be held personally liable for your customers' missed payments.
        If the debt you owe to the catalogue company includes other customers' debts then you should provide the creditor with a complete breakdown of the accounts, together with the names and addresses of any customers in arrears, requesting that the company deals with them separately.

          Running a Littlewoods Agency - Some Tips

          If you choose to run an agency, which means you will take orders and payments from customers, we would like to give you some basic tips to ensure everything runs smoothly.

          Recruiting Customers
          • Only recruit customers who are at least 18 years old, who you know well, who are trustworthy and from whom you can readily collect payments.
          • Ensure that all new customers sign a consumer credit agreement before you place an order for them. You must send our signed copy of the credit agreement to us. This is an essential form of protection for you.
          • It is very important to maintain a payment record for each customer. Create a payment card for both you and your customer and ensure that all orders, returns and payments for that customer are recorded on both cards. Both you and your customer should sign the cards whenever a new entry is made.
          • The credit limit that you offer to new customers should be based on the guidance in the following table, subject to your personal credit limit. Should you wish for further advice, please call our Enquiry Line and ask to speak to the Credit Department.

          Collecting Payments
          • Ensure that you collect your customers' payments on a regular basis.
          • Do not allow customers who have fallen behind in their payments to place further orders until they have paid all their arrears.
          • If a customer is having problems paying you, do not make payments on their behalf.
          • Contact us immediately on our Enquiry Line if a customer misses 6 consecutive weekly payments.
          • At our request, you must provide us in writing with the name, address and account information for each of your customers.
          These tips should be followed for all your customers, even if they are a relative or a close friend.

                NDR often feel it appropriate to bang their own version of charges into the mix. They dropped things sharpish when I told them that they could only do this if there was a provision for such charges in the original agreement. I asked if they would like to show me where this wasallowed in the agreement, knowing full well there never WAS an agreement. They did carry on sending staements with charges for a couple of months, but backed off when I reminded them of my first letter and told them next step was the OFT, FOS, uncle Tom Cobley and all.

                If all else fails, and they refuse to be sensible, it might come down to No Agreement, No payment. Perhaps a hint of that will make them realise that they'd be better off negotiating?

                  Thank you to every one for the useful and helpful comments, I have today obtained a little more information.The debt outstanding is £2.829.30 made up from client no1 £1.150.00 for a plasma tv and mobile, now in prison. no2 debt out standing £641.00. top of the range mobile phone, two bergerhaus jackets and shoes, disapeared. no3 debt outstanding £869.00. upright freezer £440.00, fridge £260.00, winter coat £59.00,small garden shed £110.00 dead. total £2.665.00 the rest is made up of charges by NDR.
                  It's difficult to communicate with them but we're getting there, there's a lot more information to follow after I've made a few enquieries.
