    Oporto's friend

    I have a couple of elderly neighbours (72 & 73) who desperately need help. Both husband and wife are in very poor health. MS & spinal athritis, accompanied by a form of expressive dysphasia

    My friend's wife had a Littlewoods Catalogue for many years.

    Littlewoods are harassing the wife for repayment of goods she ordered on behalf of 3 customers, but
    Customer number 1 has died
    Customer number 2 is in prison
    Customer number 3 has done a moonlight

    Littlewoods have been informed of the problems, and doctors certificates have been provided at Littlewoods request

    Despite being fully aware of the circumstances Littlewoods have now passed the account to NDR Liverpool for collection.
    The constant letters from NDR (charged to the account at £12 per letter) are of an extremely threatening nature. She is being threatened with a default and told that a collection agent is due to call at her home.
    The alleged debt is clearly increasing with every letter sent.

    The couple are distraught, they grew up in the era when debt was taboo, and the conduct deployed by Littlewoods and the heavies is further damaging their already frail health.

    Help and advice required please

    First Questions;

    Where are the goods now - I presume delivered to the customers ?

    and what kind of value are you talking about ?

    She was acting as an agent ? I presume some kind of agreement/contract applies - we need to check that for the relevant terms.

    If Littlewoods are aware of the circumstances and have requested the information re doctors certificates etc then the account should be formally in dispute and it should not have been passed to NDR.

    I think a strong letter is needed pointing out everything to head bod at littlewoods, plus one to NDR saying acc in dispute and they should pass it back.

      I agree with Ame, a very strongly worded letter to the DCA is a must.

      Whilst your friend acted as an Agent did she make out a/c cards etc for her customers and send the details off to Littlewoods. Or did she just get the goods for the customers and let them pay the a/c off without making out any payment cards etc. This is a common mistake lots of people make when acting as Agents as they don't expect people to die, do a runner or even go to prison.
      I appreciate that you are helping an elderly couple here hun and they are both unwell, so you need to see if they have any of the paperwork laying around from when she was an Agent and perhaps a gentle chat and a nudge of the memory as well.

            Oporto,

            Have had dealings with Littlewoods and NDR they do put up a fight but you will win in the end check and see if PPI was also added to the account as they did with me without me asking, you will have to be quite firm with them as I felt that they ignored most of my letters.

            You can reclaim the charges back from them.

            I only ever bought goods for myself so sorry can't help with regards to how they act when and agents customers default on paying will try and find out for you.

              Oporto, I realise its a sensitive subject but will you try and find out if the lady has any mental health problems.
              As I understand it expressive dysphasia is caused by a brain malfunction. Under the Mental Capacity Act a person would not necessarily have to be suffering from dementia etc, to be caught by the act. Any Brain impairment or malfunction, whether temporary or permanent that results in an individual being incapable of managing their affairs could possibly result in them being protected by this piece of legislation

                Hi Oporto,

                Is this the same friend I gave you the CCA request letter for some time ago?

                If so, did the letter get sent and was there any response?

                I agree that you must try to collect as much paperwork and information as you can on this one. Once we have more details I`m sure we can construct some letters to send to both NDR and Littlewoods for them.

                Are they also being harrassed by telephone? If so they need to send the letter that can be found here>Telephone Harassment Letter

                  Hi, normally when ordering goods over the phone the account holder is asked if the goods are being ordered for themselves or for someone else, also if the delivery address will be different to the account holders. If your neighbour used this option then it should be on the paperwork and in Littlewoods' records.

                  Bless them, what an awful thing to happen, thank God they have such a supportive neighbour, hope it all gets sorted soon

                          The first statement I can find from NDR is dated 16th dec 2006 and first payment to them was 5th Jan 2007.

                          Hope that helps if you need anything else just shout.

                            I'm not sure what the next move should be re this, as they have clearly filed dormant accounts when they have been active.

                              Blimey I think NDR have been in touch with us as well, I'll have to search through our mountain of paperwork and double check.

                              On a sensible note I think that a new thread should be started re NDR to stop us hijacking Oporto's, I'll do it now and copy some of these posts onto it, just look for it under 'NDR'
