    Re: Moorcroft admit no CCA

hmmm Moorcroft have just sent me an unenforcable credit agreement (ie its not even a credit agreement) off the back of a CCA request with a request to pay in full within 7 days - £1700 odd. So seems once they realise they can't enforce the debt in court - they start the pressure to pay off the balance in full.

(I'm a bit slow if everyone had already worked that one out )

Havent really thought about my one yet - will wait till i have the letter in front of me on Sunday.

And yes section 10 of the DPA - REMOVE IT FROM CREDIT FILE....no maybe about it. no agreement - no default - no mark on credit file. Do not further acknowledge debt, anything you pay is goodwill now. Oh and dont forget to tell cccs to assign that £1 to another creditor.

I will Ame, think it will be split between my two highest balances

I've not dealt with Moorcroft personally before now, but read quite a bit about them in the past and they don't give up without a fight. Good luck with yours xx

                Re: Moorcroft admit no CCA

I knew Moorcroft wouldn't leave this alone! Letter received today...
I am disappointed to note that despite our letters had none since the last one!! and attempted personal calls by our local representative no-one has called here lol no satisfactory agreement has been reached regarding the balance outstanding of £xxx they've added £12 on the above account.
In one last attempt to come to an arrangement to prevent more serious action being taken we will be prepared to accept repayment by installments of £10 pm. A giro slip is attatched for your first payment etc.
Unless a payment is received by 10am on 30/3/08 we may recommend court proceedings against you without further notice. Oh right, after admitting they can't chase this in court??
Such action could incur costs and affect credit rating blah blah...
I put this on hold for a while, til my son has recovered, just wondering if I should reply to this with a get lost letter or just wait and see what they do. If they want to play games then I might not be so willing to pay them that F&F!!

OMG, they are so thick I had the same sort of problems with littlewoods I don't think they actually read the letters you send them, just churn out the same thing to every one and I told them this, well I was getting pretty fed up of them to be honest, kept getting"we are looking into your complaint" then "we don't agree with you".
They sent one like that weeks after they had agreed with me and refunded the money!!!!

Oh Good luck with yours Ame.
Yup, typical automated letter, you'd think the DCA's woulda learnt by now but I guess they'd need more than a shared brain cell to do that!

                              Re: Moorcroft admit no CCA

I never did hear back from Moorcroft, so I gather they didn't like my offer lol.

Today I have had a letter from Red Castle Recoveries, offering me a reduced settlement, although the original debt has increased by around 46 quid. I am reluctant to send them a CCA request as I already know there isn't one. This is the first I have heard from anyone about this since March, even though their letter states their client is Phoenix Recoveries.

Will file it for now I think, and wait to see what happens. The majority of this debt is charges and wrongly charged PPI, so if they keep hassling me I will write the appropriate letter.

I agree with you file it away see what happens if anything.
