Having seen the defence, i'd wait until the case progresses.

You've said no assignment and also cca s78 response duff.

If you want to negotiate speak to them otherwise await allocation and court directions.

Nods I sent you a private message...

Since I filed a defence Bryan Carter sent me a Consent Order which more or less said I can pay by installments of a reasonable offer. My problem is I don't want to pay the whole balance and court fees (which obviously inflate the balance I am arguiing) - I know the amount in their claim is huge compared to what I owed ... I have asked for Lowells to send me an agreement/ SAR to NEXT for paperwork etc.. then I can do the sums...

So I am going to await the next stage from court at allocation and see how to deal with these solicitors at that stage then... - it's difficult when you want to argue figures/PAPERWORK? But they should prove it none the less....

If the claimant wishes to continue with the claim after looking at your defence, you will be getting a directions questionnaire (formerly allocation questionnaire).

If the claimant wishes to continue with the claim after looking at your defence, you will be getting a directions questionnaire (formerly allocation questionnaire).

Today I got a Directions Questionnaire......... from court. It is an order saying what the claimant should do.... in part 1- in part 2 it says I should file the directions questionnaire. Apparently I need to download it from court website.

And from Bryan Carter I got copy of the directions questionnaire on behalf of Lowells - they saying they agree to mediation, small claim track, no expert evidence, no witnesses and they not paid fee yet.

To date they not sent any CCA or SAR as requested....

What do I do next?? Do I just go online and do the allocation questionnaire completion?

That Order you sent me is dated 14th and you have 7 days Mrs - you have to do this today or your defence is struck out. Phone Carters (god forbid!) as the letter states they wish to settle out of court - try and sort this...
