    Just 2 tiny points:

    If the letters were sent recorded, you could request 'Proof Of Delivery' or the 'consignment number'. This is why we use recorded delivery, to show proof of delivery (funnily enough).

    With the offer of £5 per month, a maximum, all you can afford offer, Is it wise sending 3 months worth of payments??

      Thanks for the observation, i have in fact changed to just one £5 postal order- realised couldn't really afford to send more than that tomorrow.

        I had a letter from the court today regarding the redetermination. A hearing has been set for March 13th. Do I have to attend the hearing? The letter does not indicate whether I have to attend or not.

          No hun you don't have to go, redeterminations are usually done in the judges office. You'll get a letter a few days after the date.

            Yep thats right but - give the court a quick call to make doubly sure. And excellent news on getting a date.

            I tend to go along to any hearing just so the solicitors can't do something behind my back if they show up and I don't. they do seem to take it for granted you won't turn up, I think it does turn things in your favour a little if you do. Probably just me tho. It will most likely be rubber stamping desk work though.

              The letter does say to call the court regarding that days listing in case they have unavoidable delays. In which case they will pass to another judge. Will let you know how this one goes.....

              Any idea on how long I have to negotiate the withdrawing of my defence for CL Finance?

                Having read all of the above I notice that although the creditor does not have to follow the procedures of the court (Notice of default not being sent before court action) they can still proceed without a "penalty". Could it possibly be that if they "forewarn" the debtor they may attempt to clear any arrears. I have a vested interest in this post, inasmuch as I am fairly confident I did not receive such notice, missed a single payment (to a DMP) and
                received the CCJ. When it is said about lengthy court action, I can understand that a debt is a debt, but it seems too much is stacked in favour of the creditor.
