          Morning

Wait for Amy to check these first.

          To Restons

Thank you for your letter dated 29th January 2008. The contents are duly noted.

I thank your client for the indication they are willing to accept my payment offer of £5.00 per month.

However, in light of the ambiguous wording of your letter, I shall continue with the hearing for redetermination of the installment amount, as my current circumstances are u****ly to alter for some time due to my health. For this reason I feel it would be in your clients, and my own, interests if the court dealt with this matter.

Within this letter I enclose three postal orders for £5.00 each, total £15.00. Please use these payments against my account. I will continue to make payments of £5.00 on a monthly basis until otherwise instructed by the court.

With reference to the recorded delivery, I had no notification regarding this and I will contact the sorting office to place my concern. Please note my full address which should be used for communication at the head of this letter.

          Yours sincerely

            For court

Dear District Judge xxxxxxxx or Court Manager (depends if you have named judge yet)

            Claim REF: XXXXXXX

Please find enclosed documents as furnished to me by the Claimant, to be added to my file.

Within this letter, the claimant very kindly accepts a minimum repayment of £5.00 per month. Within the same paragraph the claimant also states they have furnished the court with a refusal of my offer.

I respectfully ask the court to consider this same offer and set the judgement at installments of £5.00 per month.

I have further explained to the claimant that my medical condition(s), and thus my financial situation, are unlikely to alter in the foreseeable future.

            yours sincerely

                    Account No:......................

Thank you for your letter dated 29th January 2008. The contents of which are duly noted. With reference to the uncollected recorded delivery letter, I received no notification regarding this and I will be contacting the sorting office to register my concern. Please note my full address, as detailed above, which should be used for all future communication.

(I think remove this paragraph, you've already said the contents are noted) I thank your client for the indication they are willing to accept my payment offer of £5.00 per month.

In light of the ambiguous wording of your letter with regard to your acceptance of my offer of £5 per month and specifically your use of the word "minimum", I wish to inform you that I will be continuing to court for redetermination of the installment amount.

My current circumstances are unlikely to alter for some time due to my poor health and for this reason I feel it would be both in your client's and my interests if the court were to make a final decision on the monthly payments to be made.

I have, however, enclosed three postal orders for £5.00 each with this letter - total £15.00. Please apply these payments to the above mentioned account. I will continue to make payments of £5.00 per month thereafter until otherwise instructed by the court.

                    Yours sincerely

                    cc: The court

                          Claim REF: XXXXXXX

Please find enclosed a letter to me from the Claimant dated..........., to be added to my file.

Within this letter the claimant appears to accept a minimum repayment of £5.00 per month, but also bizarrely contradicts this by stating in the next sentence that they have furnished the court with a refusal of my offer.

Understandably, I am very confused by the contents of their letter and in particular with their use of the word "minimum". As such I respectfully request that the court consider my offer and set the judgment to repay at installments of £5.00 per month.

I have further explained to the claimant about my medical condition(s) and thus my financial situation is unlikely to alter in the foreseeable future.
