        Is the court date good news or bad ? Is it for the hearing of your application to order compliance with your CPR 31.14 request? and have you had any copies of the documents from the claimants yet?

          hi amethyst its for application to order compliance with your CPR 31.14 request and still not had any thing from claimant s as yet

          was looking at particulars and states contract and there solictor in letter i posted states this is a simple contract ?

            and the time its took to come to court and if no documents come forward on 28 april the claim should be struck out or will that be a struggle to get thrown out

              notice of discontinuance of proceedings

              take notice that the claimant hereby wholly discontinues this action against the defendant
              we certify that we have given notice of discontinuance of proceedings to every defendant against whom the claimant
              desires to discontinue
              signed bryan carter
              advise on this part of letter

              at bottom of letter states this
              n279 notice of discontinuance of proceedings

                      I'd be inclined to go for a wasted costs order now, though await Amethyst (and others) input on thatbefore going for it

                      Theyve embarked on a claim they could not substantiate so they should pay you for your wasted time, printer ink, paperr, postage, application cost, etc

                            Dear Sir/Madam

                            Case name and number

                            I wish to inform the court that the claim as detailed above, in which I am the Defendant, has now been discontinued (I have attached a copy of the Claimant's notice of discontinuance).

                            However, I believe that the Defendant has behaved unreasonably in their approach to issuing this claim, as clearly he failed to obtain the documentation required to substantiate a claim prior to issuing proceedings.

                            I would therefore request that the court consider making an order for wasted costs under their case management powers contained within CPR 38.6.

                            I request the following:

                            My time to investigate the Claimant's claim and relevant legislation, respond to Claimant and court - 5 hours @ LIP rate £18/hour = £

                            Printing paper = £ (insert amount reasonably spent)
                            Printing ink = £ (insert amount reasonably spent)
                            Telephone calls = £ (insert amount reasonably spent)
                            Travel time required to post items= £ (insert amount reasonably spent)
                            Fuel = £ (insert amount reasonably spent)


                            (REMOVE ANY NOT APPLICABLE/ADD ANY OTHERS THAT ARE REASONABLE)

                            TOTAL = £
