    I have been in discussions with Cowboy Traders, ITV Daybreak and Trading Standards scam busters division as well as normal trading standards. We've done witness statements, I have all the stuff from the FOS (who are useless).. but to prove at no time in this 2 and a half years have we ever ignored this situation. I have all the paperwork from the first solicitor when we didnt get the insurance to prove we are trying to take THEM to court. We also have the paperwork from our new solicitor to prove we are still trying to take them to court. A judge will see that and apart from that we pay all our bills. I'm not going to pay for somebody mugging us in our own home.

      And CleverCloggs.. I absolutely love this .. because I didnt know that! Unfortunately for them, it is not really a matter for them to decide as is made plain by section 75A (4) - suitability is for the debtor to decide -

        I watched the the Ch4 Despatches program about debt collectors when it was screened over a year ago, it was focused on marlin in particular.
        I think the OFT and trading standards would be very interested to hear more details of marlin at work.

Some of those posts are mine, :biggrin1: quite a few of us trawled through the sites, looking for examples of Marlin's dubious practices, :evil: in particular serving papers at an old address in order to obtain default judgment, :rant::rant::rant:which is what happened to someone related to the owner of that forum.

          I was on a site student site organised by Fuzzbutt.
          we all joined a class action lawsuit against Barclays during 2011 we had over 1200 students all advent BPF customers, but the problem was there was too many of us, barclays lawyer wrote asking for specific names and cases, our lawyer agreed she could not represent so many people with so many different scenarios so we had to drop it.
          Then end of 2011 myself and about 6 others contacted a lawyer not far from where I live his company was prepared to defend us in court on a no win no fee basis, but he asked for around £2,600 (cant remember exact amount) up front to pay for court fees we was to divide this up between us, I had the money ready but others asked for time to get this amount.
          By the time others had got their money the lawyers company had changed their minds made an excuse that they had not expected to have to wait so long.
          I have the emails to prove this was ongoing.
          we also watched Fuzzbutt as she collected her documents ready for her country court day with barclays.
          with her the situation was very different she had already paid her loan off and she was about 2/3 of the way through she was claiming for the full amount of the course plus her expenses barclays disputed it all, but in the end they had a judgement against them.

          she is one very tenacious woman she was the one who organized much of our original legal challange.

              Yeh witness statements is a must, together with the court action stuff that never quite happened.. people who are just trying not to pay their bills without a valid reason, arent trying to take the creditors to court. It shows we are proactive, and the more people who can back up your case in court the better.

                The getoutofdebtfree site says you dont have to pay any bills.. i like their approach, but i couldnt give their template letters to a judge.. I'd have no problem sending them to a debt collector.

                  Its a shame the last lawyer messed about , we only had to find about £540 each to pay the court costs but the others took 5 months to get their money together when the spokesperson for our group contacted the lawyer he said too late

                    want to also point out the lawyer informed us we each had very good chances of winning our claim otherwise he was not prepared to represent us, he had sifted though other students that had asked to join.. we 6 were the ones he selected as good candidates

                      I just had a message from somebody on the Facebook forum. He got the same 2 letters at the same time as us. He got a letter from Marlin today. Have you heard from them yet 10pack? I'll let you know what it says when he lets me know.

                        I have not heard anything back from marlin since my conversation on phone with them last Monday it was the second call I had made to them and the last, I told the rep since you do not have a signed copy of my agreement and will not provide me with a true signed copy of the deed of assignment I do not recognize any debt owing to your company.
                        Next week I intend to send a challenge letter asking for those documents they will then have 12 days to either produce them or go away.

                        But I need to start county court proceedings against BPF and not just for the loan but also for stress caused and damaging my credit worthyness.
                        I have asked someone I know who is a lawyer about it.

                        I intend to have this sorted this year its dragged on long enough for one reason or another.. I have been having problems with a certain person who I wont go into details about, but I now know people who can do anything for money.. anything.

                          Its just a standard letter saying they are recovering the debt and the need to 'speak' to him - I'm sure they'd love to!

                          It's giving him 5 days to arrange a payment plan or pay the debt or he can fill in a statement of means form on the back of the letter with his proposed offer.

                          I'm sure my boyfriend will receive this letter on Monday.

                            that is not the same type of letter that we have is it? I do not see anything asking me to fill out a statement of means ?

                              No this is the second letter from them. The first was the 2 letters in the same envelope. This will be the first letter send directly from Marlin.
