No - he obviously meant disc jockeys.

(Ask a silly question... of course he meant District Judges!)

I find that quoting statute legislation and case law in a defence puts a judge on notice and still holds the field

i have never been a fan of a judges interpretation of the law, the law is the law, and i follow it to the letter

through out this thread, all that seems to have happened is we have just confused the poster for no reason

this is the second time we have clashed over statutory obligation and in future, if we disagree, might i sugest we start our own thread on the matter

please do not take offence as i am willing to learn and your arguments have been sound to debate, but most posters will not have a clue what we are talking about and the last thing we need is disharmony
These threads are read by other people apart from the OP, some blanket statements do not apply in all cases, the LOPA for instance will not apply in the circumstances i point out, i make no apology for mentioning it.

          Re: Cap quest! Help please

          like i have stated

you have no reason to appologise for making any statement and i value those statements, just as much for you to value mine

its just i do not consider those indepth complicated arguments to be made on the OP thread

lets move the finer points of law to another thread

          that is all

          regards

The fact that these arguments will not apply to post Feb 2012 agreements is not complicated.

                    Re: Cap quest! Help please

your case may be processed, we may issue legal procedings, we may take you to court

if you have not contacted them i would still ignore the cretins until they send an assignment notice as to s.196 lop Act 1925

                    but thats me

only you can make your own decision

                      Re: Cap quest! Help please

No I haven't made any contact with them all correspondence I have received from them I have forwarded to you so I'm guessing none of them are the assignment notice? What happens if they send my case to court would they notify me before so we could get it thrown out for not sending assignment

                        Re: Cap quest! Help please

if it does go to court then we just put in a defence

where we have them by the short and curlies is they need to be sure they are communicating with the debtor and no one else (data protection act) shame that

And how do we establish that they were just guessing? Is it by me not responding to them

that is why they keep asking you to contact them and admit the debt, they have you then and they will destroy a rain forrest in threatograms and enough telephone calls to pay the national debt

at the moment they think you are the debtor, but they need you to confirm it

it would not look very good if they served court papers on someone with the same name , would it

but you have no knowledge of this debt as you never have had any dealings with crappyquest as a creditor in your past

you have never heard of crappyquest

AS YOU HAVE NEVER BEEN SERVED WITH AN ASSIGNMENT NOTICE

crappyquest could be anyone demanding money
