          That the terms they sent you cant be the ones you signed in 1996 as Citi didnt have anything to do with avco in 1996 ?

            or should I be honest and say skipped through it, That is why your the Sorcerer and I am the apprentice, it was just the bit about what I read on different sites referring to this case that the Judge ordered the company either to repay Mrs Thorius's PPI premiums and interest, or the value of the commissions it had received which so far has been undisclosed."that's what threw me, but as far as I can see it dose not mention anything about this on the actual Judgement you posted my apologies.

            As regards the T & C'S didn't think it mattered whether they were the right ones or not these days after the Carey case and the one Optima Legal were involved in, or am I missing something yet again.

                  So does that mean robbersway are stuffed,but the PPI route is still the best way to go.

                  Only prob I can see then if as Amethyst pointed out earlier (assuming the damn regulators don't let the banks get complaints handling waivers with this Judicial Review going on)

                  Then she will be stuffed, am I right here.

                      So what do you reckon now that all then cards are on the table, does she stop payments and wait for their next move taking into account what Wendy B said "if she stops paying they will no doubt take her to court so that would be like opening the door to the courtroom and asking to be let in".

                      Or does she carry on making the payments and go for the PPI.

                        My opinion, for what it's worth. would be to carry on making the payments and go for the PPI. Wasn't that the plan in the first place, to see if the PPI could be reclaimed and possibly used to settle and/or reduce the balance?

                          Tinks, before going full throttle on any one course of action based on what you have read on forums, it is always best to read the original source of the information. Especially in the CCA areas as there is a heck of a lot of misinformation out there.

                            As I think you know, I'm all for going the PPI route, so I agree with Wendy. We may be able to get a ball-park figure of what the PPI route might yield, if we put what we know into a spreadsheet. If that is enough to clear the debt, then you will:

                            1. Clear the debt COMPLETELY - and by that, I mean that they cannot keep chasing you for payment and put markers on your credit record, which they may try and do if you just get unenforceability.

                            2. Clear the debt PERMANENTLY - as opposed to the temporary nature of unenforceability.

                            3. Receive a cheque for any amount over and above that which is needed to clear the debt. Remember that you will be able to claim 8% interest on ALL PPI paid to date.
