    I don't doubt you are genuine Godzilla, we only want to help, and the letter from Sainsburys is important. However if your legal advisors think it is sound, then of course you have to go with them as it is they whom you trust. We couldnt advise whether to go into a case without knowing the facts, and those which we have are not enough for us to be able to say go for it without having reservations about the possible costs impact on you and your familty. However i understand you have not asked for this advice simply the case law, which Cetelco has attempted to provide.

            This is a message from Godzilla to you all,


            I have printed(Word for word) the letters that I spoke of yesterday, and I have sent them in a private message to Amethyst giving my full permision for them (The letters) to be forwarded to Natweststaffmember.

            I have done this because I do not want any of you to think of me as a liar.


            Luggerbugs has sent me a private message and his behavior towards me is unwarranted and unqualified.
            Luggerbugs refuses to post a public apology to me here, and clearly an apology is what I deserve, in public.

            This person(Luggerbugs) is fast to defame me, yet slow to addmit how wrong they are, and what difference does this make to me? None, as I need not Justify anything to any man!

            Whereas this person(Luggerbugs) needs to justify why, when it be known that they are so wrong, do they not accept their mistakes and make amends.

                Thank you godzilla. I have now received the letters and discussed the content with NWSM.

                This seems to be the order of events if you can confirm this.


                1: You had a payment arrangement with Sainsburys to pay a minimal monthly payment of £1 until your circumstances improved.


                2: You managed to get the money together to make F&F's on your debts so you wrote to Sainsburys offering a final payment of £3.9k odd to clear the account.

                3: Sainsburys replied declining the offer and asking you to resume payments of £1 as previously

                4: There was telephone contact in which you were invited to make an offer of 80-90% and it would be considered

                5: You responded by sending cheque for the £9k as full and final

                6: They replied accepting the payment on your account and stating you retained an outstanding balance of £1.7k (approx 17 days between date of letter sending cheque and them writing reply)

                7: You didn't make further payments of £1 nor any other amount

                8: Sainsburys defaulted your account and sent the balance stated of £1.7k to the debt collection agencies.



                Now further on in your thread there is mention of the offer to wipe the account and pay £1k compensation. If you have the letter detailing this it would be good to see.

                Can you outline simply and breifly what occured following the account passing to the 4 Debt collection agencies please.

                  Godzilla,

                  You must have paid a small fortune in charges (and interest there-on ) on this card (please correct me if I am wrong or you have already claimed it back).

                  If that is the case have you applied to have them returned using Budgies compound contractual interest calculator you may well find that an overpayment has taken place.

                  It may help your case.

                  Just for clarification if you have legal advisors in this matter, if so why are you posting on this site at all?

                  Are they not up to the job ?

                  The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

                    Hello and good afternoon Amethyst and Natweststaffmember and thank you,



                    Firstly, can I just say, the teleponed agreement(Meeting of the minds)with Sainsbury's was that I was to send in the letter of my settlement payment offer with the said cheque payment enclosed with it(The offer letter), and this is precisely what I did, I did not just send in a cheque on it's own.


                    The letter of response from Sainsbury's, shows that Sainsbury's have broken the agreement in as far as, agreeing to give consideration to my offer of settlement payment, and informing me as to whether or not this offer of mine is going to be accepted or rejected, just like they did in response to my first offer(Reject it I mean, this first offer).



                    And as you can see from Sainsbury's response to my second offer of settlement payment-cheque enclosed(as requested by Sainsbury's), Sainsbury's "Balance Request" letter is merely "A Receipt" of "A Payment" made to my account, this letter(From Sainsbury's) does not state that they(Sainsbury's) have taken the said payment on "Account Only" nor does this letter state that Sainsbury's "Reject" the payment as a settlement, or the terms of the payment in offer of settlement.


                    There is no mention of "FULL AND FINAL" in this letter(Stated above) from Sainsbury's, whereas in response to my first letter of offer of settlement Sainsbury's showed themselves as being perfectly capable of rejecting an offer if they wanted to reject an offer, both letters are from the same department and same manager(Senior manger) of Sainsbury's. This "Balance Request" letter is a "Considered" response, a conduct of deceit.


                    I know you wanted this short, I am sorry, but I am just trying to get the vittal piont/fact across.

                    Sainsbury's disregarded my letters of complaints/disputes to them and passed my details to the DCA'S.



                    When Sainsbury's passed this alledged debt to the DCA'S, Sainsbury's falsely claimed to them (The DCA'S) that I had used up a credit to a different account number, a credit of £1,757.00 and that I was refusing to pay and that I had not made any payments to this account.

                    This account was different to my one, original and only account and I had no credit agreement with Sainsbury's for this other account regulated or unregulated or any type of contract for this other account.


                    I told the DCA'S month-in and month-out that this alledged debt had been passed on to them illegally and that it was not mine as I had made a settlement payment with Sainsbury's to an account that was totally different to what they were pusuing me for.

                    All of the DCA'S reported this dispute back to Sainsbury's, and then came back to me(The DCA'S) stating "Sainsbury's say you have not made any payments to this account and Sainsbury's say can't find any record of settlement/Full and Final Payment to this account, no record of any payment to account, pursue, pursue, pursue".


                    These DCA'S were given no proof from Sainsbury's that this other account was mine and accepted Sainsbury's word as a fact.



                    I am again, sorry for the length of this, but it is very complicated and there are many intricate and crittically important details to this case.

                      Godzilla, can you PM amethyst the final letters that you have written to sainsburys re points 21-23?
                      Need to have a quick once over and see what they have written to have an idea in my mind how this panned out in their eyes.
                      Furthermore, did you keep a log of all calls you made and the person you spoke to as that could be important as well?

                        I can understand where you are coming from in that they havent specifically rejected the offer, although they havent accepted it either. What we need is the case law saying that in order for a F&F offer to be refused it has to be specifically refused as opposed to just not accepted as full and final.

                          Re the DCAs -did you request the deed of assignment of original credit agreement at the time when trying to show the DCAs were collecting illegally?

                                Are they bringing the action for you, or just giving advice?

                                Can you also let us know, for reference, which case law they are basing your case on as it may be helpful for others and I would be interested to read the cases to see if they are the same as the cases I have read up on.
