To Cetelco,


Sainsbury's sent a "Receipt" for "A payment" that was made to my account, Sainsbury's did not reference "Full and Final Settlement" in this letter of "Receipt", nor did Sainsbury's reference "Partial payment only".

There is no mention in this "Receipt" letter of the amount paid into my account, there is no "Rejection" to the payment being a settlement or of the terms the payment was tendered by, it is merely "A receipt" of "A payment"


Sainsbury's can argue all they like, that this "Letter of receipt" was meant as a "Rejection", but the fact will remain, that they did not state this in this crittically important communication to me.


If it is to be accepted that Sainsbury's "Mindlessly" banked the said cheque,
then it also has to be accepted that the series of events that unfolded over the next sixteen and a half months were also, "Mindlessly executed".

Can you post the entire letter rather than just parts you think are relevant.
The letter will need to be read as a whole to gain the full context of the letter.

I will be going to court against Sainsbury's and the other four companies as I refuse to let the injustice go on it's way, unchallenged!

If its justice you're after then you are probably best to wait until you get to heaven, assuming you believe in such things.

courts are no more about justice than they are about the law.

when all is said and done going to court is about trying to get something, another party refuse to give you.

Right and wrong have little to do with the outcome in court, it has everyhintg to do with how the parties involved play their parts.

I do hope you get what you wish, my fear is you will get well and truly trounced by the other side because they play the game professionally and it will cost you more than you can afford to loose.

Hope I'm wrong but please don't ever think the courts are about justice,

Yes I will post the said letter here.

I will post Sainsbury's letter of "Rejection" to my first offer of settlement payment, and also Sainsbury's letter of "Reciept" to my settlement payment offer letter - said cheque payment enclosed,attached to said letter, sent to me by Sainsbury's after they banked the said cheque settlement payment from my father-in-law.

I will print both letters word for word in about 30mins time if you accept that as being OK to do so.

Both letters are from the same department and the same manager, but I will not print his name as I do not have his permission to do so(DPA), but you will see that Sainsbury's were perfectly capable of rejecting an offer if they wanted to reject an offer.

The only reason we are asking to see the letter is that it is confusing from what you have said thus far exactly what it says.

If it says as you have stated that Sainsburys accept the payment on account then that is different to if they accept the payment as full settlement of the debt and close the account.

If you would like to PM one of the team the wording of the letter than that will be okay if you are happy to do that.

Just wanted to explain the forum a little if I may? You have made a few comments on the thread that made me think you didnt quite understand the fourm- I struggled when I first started using forums.

The forum was set up by the users with their names in red and is run by the users with black and purple names, the people with yellow names are VIP and have access to additional parts of the forum and the shout box. No-one is paid for what we do on here.

Some of us have a legal background; most of us, like yourself have researched the law and case law to help ourselves and others get out of debt, reclaim bank charges and much more.

We are here only to help ourselves and others, we get nothing further out of this. You are essentialy talking to regular people all over the UK, every opion expressed is out own and does not reflect the opinions of the forum.

I joined these fourms for the first time three years ago and spent the first 6 months trying to work out who the people were and what was going on lol I still have issues working things out now pmsl.... anyway hope that explained the way the forum works and who we are and that I haven't confused you

I do not doubt you but I have worked for 10 years in banking up until earlier this month. Their response to you is vital for me to understand how they have interpreted your complaint. Furthermore, their explanation of what they have done to rectify the situation should tie in with the 23 points that you have mentioned(they might have missed certain things that we might see as important). A further issue is to do with how they have compensated you and what you think is reasonable. I have no problems with being very blunt in what I think if it appears to be unreasonable. To cover briefly something that I have worked out from your thread. They have not damaged your ability to get credit, since the default was removed and you never sought credit while it was active(there was a case which that did happen and there was unlimited damages awarded....from my reading of your case, this is not the same). They have made an offer of £1000.00 which you have rejected and I still have no idea how or why they offered the amount and why you rejected it.

Will you kindly give an explanation?

Godzilla, I don't doubt your case at all but unless you gain a picture in your mind of how both YOU and THE BANK are thinking, it is very difficult to advise you. If you're legal advisors are saying to be careful about posting on the forum, then why do we need our/my help?
There are hardship cases on the forums, there are people dealing with bailiffs NOW and they do not have legal advisors and they are scared. They are the ones who perhaps warrant our attention so that they can deal with their struggle.
Good Luck, but I am stepping out of this thread unless you have anything further that you can add to this thread that is not already there. Please update the thread because it is always good to see how you have/are getting on but I cannot advise further because of the lack of information about how the enemy are thinking, so to speak.

May I suggest that you follow their advice as they are the ones who are legally trained in this matter.

I cannot see how we can help you now, as you cannot post the information that we need to help you.

Now I really do have my doubts about this guy. Apologies if this sounds harsh, and even perhaps totally wrong of me. But I think we have someone who just gets off on jerking everybody's chains.

I can see no harm in doing what thousands of others have done in the past, and that is to post up documentation with identifying details blanked out.

But he seems reluctant to do this. Why is that? Genuinely cautious? Or there being no documentation whatsoever, and by inference, he's wasting everybody's time for his own obscure reasons?

If it's the former, then what the heck is the point of coming onto a public forum for help?

If you are case law you can use http://www.bailii.org/ OR you can ask your lawyer to research it, any competant lawyer will have access to the finest electronic law libraries in the country.

Why do you crave to see such documents, go with your own instincts and do not bestrew them upon others(Your feelings, that is).

Please can we keep this thread to the facts of the case. We have asked the OP for the text of the letter which is the main basis of his case and details of the case and he is not willing to post further due to concerns of privacy. That is his choice and should be respected. If he wishes to send the information directly to Admin so it remains private he may do so at admin@legalbeagles.info.

Case law was asked for and assistance offered and I think that is all we are able to do without further information.

I most graciously welcome your latest entry, and you are absolutely right, there is no point in anyone posting to my thread if all that's going to be posted is nothing more that babblelisticaly spoken, babylonian nonsense.


I seek no argument with anyone I just wish to know if anyone has had a like for like situation such as mine, or if anyone knows of anything that is precisely like it, that's all.


My case is genuine, my wife is very, very ill suffering from the dreaded disease MS-secondary progressive, I AM NOT A LIAR, I am a very private person and simply because I do not follow a pattern that has been created by the majority, it does not mean that I am a fraud, there is no desire in my heart to waste anyone's time.


I am still researching and looking to find information on harassment by banks, there are some cases that have been reported in the media I know, but these cases can not be used as a comparator for my case of harassment from a bank and four other companies.


I am very, very gratefull to all of you who have posted here and I do hope that you will continue to offer any advice that you feel would be usefull to me, of coarse I do not want any of you to feel that you are wasting your time with me on this thread, I am genuine, I have spoken the truth to you all.
